Applicant requesting rezoning from C-2 Commercial-Industrial to C-1 General Commercial in order to comply with the Comprehensive Plan 2. After subject property was annexed in 1982, rezoned from A- O to C-2 3. At that time, zoning ordinance permitted all C-1 uses, including shopping centers to locate in C-2 district 4. Rock Prairie Crossing center developed as a permitted use in 2001 5. UDO adopted in 2003, retail centers over 50,000 sf not permitted in C-2; therefore existing shopping center made a legal non-conforming use 6. Applicant interested in rectifying the non-conforming use by rezoning to C-1 7. Uses in C-1 are consistent and compatible with the retail center, whereas uses permitted in C-2 allow more industrial retail development, which would be inconsistent with surrounding area 8.
