HomeMy WebLinkAboutWritten Interpretation Request (frff CITY OF COLLEGE STATION 10 September 2007 Will Ogilvie Vista Equities Group 1117 Eldridge Parkway Houston, TX 77077 RE: Written Interpretation Concerning the Parking Determination for Precision Eye Care Dear Mr. Ogilvie: This letter is in response to your request for a written interpretation concerning the minimum number of off-street parking spaces required by Section 7.2 I of the Unified Development Code (UDO), specifically as it relates to Precision Eye Care, located at 3975 State Highway 6 South, Suite 900. Background Precision Eye Care is located in The Plazas of Rock Prairie, an 18,661 square foot commercial center located at 3975 State Highway 6 South. The current zoning for the subject property is C-1 (General Commercial). The site plan for The Plazas of Rock Prairie was reviewed by the City of College Station in August of 2006. The site plan provides for 79 parking spaces and a parking/area ratio of 1.04 spaces for every 250 square feet of building area(1.04:250). In February of 2007, the city received a building permit application for the first tenant finish out in The Plazas of Rock Prairie, Luigi's (a 3,000 square foot restaurant). In March of 2007, the city received a building permit application for the Precision Eye Care, occupying 2,100 square feet of the center. Prior to issuing a building permit for either project, staff determined that both uses were considered intense uses for the purposes of Section 7.2 I of the UDO. Section 7.2 I of the UDO states that no more than 25% of any shopping center's area shall be utilized for intense uses (uses that, individually,have a parking requirement greater than 1:250 in C-1 or C-3 zoning districts and 1:350 in the C-2 zoning district). The total area occupied by Luigi's and Precision Eye Care is 5,100 square feet and represents more than 25% of the shopping center's area. 'Ze city received your application for a written interpretation on 30 August 2007. the heart of the Research Valley P.O.BOX 9960 1101 TEXAS AVENUE COLLEGE STATION•TEXAS•77842 979.764.3510 www.csbc.gov Determination After a careful review of the information provided on the application for written interpretation along with the information contained in subsequent e-mail correspondence, the determination is that Precision Eye Care should be classified as a retail sales and service establishment. Staff's evaluation of the supporting information indicated that the sale of vision related merchandise was the primary activity and eye examinations were incidental to the sale of such goods. The parking ratio, per the UDO, is 1:250, therefore, the area is not considered an intense use for the purposes of Section 7.2 I of the UDO. This interpretation may be appealed to the Zoning Board of Adjustment (ZBA). The next available ZBA meeting date is 6 November 2007.
