Page 1 of 2 Lance Simms - RE: Written Interpretation From: "Will Ogilvie" To: "'Lance Simms' Date: 9/7/2007 2:34 PM Subject: RE: Written Interpretation Lance: The person who owns the store is an Optometrist, not an Opthamologist. She is licensed to fill prescriptions for eye ware, as well as to do an on-site exam to prescribe eyeware. She does not do any actual procedures, surgeries, or emergency care, as she is not a licensed physician. The vast majority of her business is that of a retail operator, and thus her parking requirements are as such. Thanks for your help! Will Ogilvie Vista Equities Group,Inc. You stated that Precision Eye Care can provide on-site eye exams. Do they routinely have an eye doctor or other licensed practitioner on site to provide eye exams? This information is critical for us to be able to make an a correct determination. I may be able to help clear up any misunderstanding concerning the occupancy load reference in your e-mail. That calculation originates from the building code and has no bearing on the interpretation of the parking ratio established by the UDO. Thanks again and I look forward to your response. Precision Eye Care is owned by 1 physician. The primary business of the store is the retail sale of eye glasses. They can provide on site exams, but again they typically are filling prescriptions. There are no surgeries or procedures performed on site. They are currently designated at High Intensity, but my request is that we look to designate them as a general retail usage, given that that is how their business actually operates. The fact that they were allowed to be permitted with only one toilet and a maximum load capacity of 15 people in over 2100 square feet of space reconfirms in my opinion that upon further review it is apparent that Precision Eye Care is not a high intensity usage. file://C:\Documents and Settings\lsimms.CSTX\Local Settings\Temp\XPgrpwise\46E16167... 9/7/2007 Page 2 of 2 I look forward to your comments, and thanks in advance for your help. In order to provide an accurate interpretation, I need to clarify a couple of items and get some additional information. Clarifications: * The interpretation requested on the application stated, "Precision Eye Care is a high intensity usage". I assume you would like to know if Precision Eye Care is considered a high intensity use for the purposes of Section 7.2 I (Minimum Off-Street Parking Requirements) in the Unified Development Ordinance. Could you please confirm my assumption? * The application requested a reference for the specific code section in question. That information was not provided. I assume the code section in question is Section 7.2 I (Minimum Off-Street Parking Requirements) in the Unified Development Ordinance. Again, could you please confirm this assumption? Additional Information * I need to know a little more about Precision Eye Care. Specifically, do they provide eye exams or do they simply sell eye ware? * If they provide eye exams, is that service provide by a professional (i.e., an eye doctor or other licensed practitioner)? Thanks for your help. Please let me know if you have questions. Lance Simms, CBO Assistant Director of Planning & Development Services City of College Station, TX Phone: 979.764.3741 College Station.
