They did a preliminary plat, but have not done a Final Plat. They are having to wait on utilities to be
extended to this tract before they can final plat, due to the utility requirements of the final plat.
I can get you a copy of their preliminary to show you what they had planned to dedicate, typically the
preliminary plat and final plat are very similar. Let me know if you would like this information.

the easement?

No I would not think so. The city is doing them a favor by extended utilities to their property, without
these extension they can not plat. I assume you are needing an easement from them to extend a water
main?

Sounds good. I have attached their preliminary plat for you reference. They actually did do a final plat
but it was not able to go forward for approval at P&Z because of the utility issues. The attached
preliminary was approved by P&Z.

Josh,
I think you are in communications w/ Stephen Maldonado, but to reinforce the message....
Please do not permit the landowner to dedicate the corner of their lot to TxDOT. There are two
reasons....
1. The PUE to be purchased by the City has been prepared to reflect the existing property line (not the
proposed PL after plat).
2. The rules may have changed since I left TxDOT, but the only way to dedicate property to TxDOT is
through approval of the Transportation Commission. Do not think TxDOT will accept or maintain the
dedication area.

Mark,
The dedication of ROW was reflected onthe Preliminary Plat which was approved by P&Z. I assume the
applicant will be bringing the Final Plat (record document) forward for P&Z approval at some point after
the water line is complete. When the Final Plat is submitted, we will ask the applicant to remove the
ROW dedication and reflect the existing property line.

Thank you, Josh. It has occurred to me that so long as the College station easement is first in title, then
we will have superior rights to TxDOT. But, it still is probably best if they did not dedicate right of way to
Wellborn Road.
