GENERAL VARIANCE REQUEST
The following specific variation from the ordinance is requested:
To add a bathroom and break room/office for personnel on the property line. The current property was built on
the property line in 1969. I would like to add a bathroom on that meets today standards for the diabled and
elderly. I am a dentist and this would be an asset to the staff and the patients. I also do not have a breakroom
for my staff. This would not seem important to many businesses but we must adhere to strict OSHA
ordiances. I would like to provide a breakroom for that staff that would allow them to keep their lunches and
food away from our lab, sterilization center, disposable trash.
This variance is necessary due to the following special conditions:
Special Condition Definition: To justify a variance, the difficulty must be due to unique circumstances
involving the particular property. The unique circumstances must be related to a physical characteristic of the
property itself, not to the owner's personal situation. This is because regardless of ownership, the variance will
run with the land.
Example: A creek bisecting a lot, a smaller buildable area than is seen on surrounding lots, specimen trees.
Note: A cul-de-sac is a standard street layout in College Station. The shape of standard cul-de-sac lots are
generally not special conditions.
I need this variance to add-on because current set backs are not possible. When this property was built the
building was placed on the property line with no set back.
The unnecessary hardship (s) involved by meeting the provisions of the ordinance other than financial
hardship is/are:
Hardship Definition: The inability to make reasonable use of the property in accord with the literal
requirements of the law. The hardship must be a direct result of the special condition.
Example: A hardship of a creek bisecting a lot could be the reduction of the buildable area on the lot, when
compared to neighboring properties.
I am not able to add a break room or bathroom on this property unless there is no setback.
The following alternatives to the requested variance are possible:
Move to another location --- however I would like to stay at my current location, add on the enhancements and
remodel the building to help enhance the entrance to historic Eastgate.
This variance will not be contrary to the public interest by virtue of the following facts:
I am not invading anyone's property . I would be enhancing the public interest by making my location
safer, help generate tax revenue and more esthetic. I also would prefer to be in OSHA compliance
on the employee break room. I also need an ADA handicap compliant restroom for my patients
especially the elderly patients with special restroom needs that I see daily in private practice.
