Records of Brazos County, Texas. The granting of this Easement and Right-of-Way would
. be subject to the following: •
•1). Frank Matous.Jr., Helen Francis Ma'tous, Frauline Putz Sims,James W. Sims,.
Elizabeth Ann Matous Swetish and Steven Swetish, (hereinafter jointly
• referred to as "Grantors"), agree to grant to Columbia Gas Development
. Corporation ("Columbia"), an Easement to allow for access across' the
• property described above for a period of eight (8) years, beginning January •
14. 199.4.
• 2). The Easement would be approximately 1,500 feet in length and 30 feet in
width. The road to be constructed by Columbia would be approximately 18
feet wide with ditches on either side. The road base would be dirt covered
. with aoproxirnately 6 inches of gravel or caliche. All trees which are cut will.
either be stacked and burned or removed from the site by Columbia. A gate
and caalzguar^ would be installed at the entrance into the property from
University Drive and a gate and cattleguard would be installed at the point
the Easement terminates at the northwest property line with the City of Bryan
50 acre tract. Columbia and Grantors agree that these gates shall remain
closed when not in actual use. The road, gates and cattleguards would be
maintained by Columbia during the term of this Agreement and Columbia
agrees to take such reasonable measures as necessary to prevent erosion cr
' to promptly repair any erosion damage caused by Columbia's actions within
the Easement. A photocopy of an aerial photograph labeled Exhibit "A" is
attached showing the approximate locations of the Easement,cattleguards and
. gates.
Upon Grantors execution of an Easement and•'the start of actual road
construction. Columbia agrees to pay Grantors the sum of twelve thousand
