Since construction has been approved,please be advised that the developer now enters the two- year maintenance agreement period and is responsible for all repairs and up-keep of all roads, drainage structures and signage associated with said subdivision. The construction bond/letter of credit must now be replaced with a maintenance bond/letter of credit,which shall be 10%of the amount of the original construction bond/letter of credit. The maintenance bond/letter of credit is to be kept on file at the Brazos County Road& Bridge Department. Brazos County requirements and specifications regarding concrete in county right of way will be strictly enforced per Addendum(see attached copy)to the current Brazos County Subdivision and Development Regulations(approved by Commissioner's Court May 24,2005)which stipulates concrete on driveways/entrances from the roadway to the right of way line is not permitted. Also,permanently constructed mailboxes must have their face at least 5 ft,from the edge of the driving surface. Please note on all future phases(to this or any development),as the developer,you are responsible for policing all builders on installing the driveways and mail boxes/stands in accordance with the current county regulations. McGREGOR SURVEY, Abstract No. 170 in Brazos County, Texas and being part of the called 188.04 acre tract described in the deed from Thousand Oaks Development Co., Joint Venture to Duck Haven, Ltd. as recorded in Volume 4011, Page 142 of the Official Records of Brazos County, Texas (O.R.B.C.) and being more particularly described by metes and bounds as follows: COMMENCING: at a found 1/2-inch iron rod marking the south corner of the called 188.04 acre tract, a west corner of a called 459.02 acre Lena Fachorn ls`tract described in Volume 1549, Page 80 (O.R.B.C.) and being in the northeast line of a called 503.39 acre J.C. and Eugene Wade ls` tract described in Volume 159, Page 201 of the Brazos County Deed Records (B.C.D.R.); THENCE: N 45° 00' 00" E along the common line of the called 188.04 acre tract and the called 459.02 acre tract for a distance of 328.15 feet for corner; THENCE: N 11° 10' 51" W into the interior of the called 188.04 acre tract for a distance of 337.89 feet to the POINT OF BEGINNING; THENCE: continuing through the interior of the called 188.04 acre tract for the following four(4) calls: 1) S 18° 47'44" W for a distance of 46.17 feet for corner, 2) N 71° 12' 16" W for a distance of 20.00 feet for corner, 3) N 18° 47' 44" E for a distance of 80.85 feet for corner and 4) S 11° 10' 51" E for a distance of 40.03 feet to the POINT OF BEGINNING and containing 0.0292 acres of land, more or less.
