It would be hard to enforce to try to divide up a building and keep track of it over time. Just FYI though, outdoor seating for customers is part of the Allen's contract. As for the distance the way TABC measures (from front door straight to property line, down property lines, then to front door) it is over 800 feet to Scott &White. It is still over 580 feet"the way the crow flies." I never knew they flew so straight! Molly >>> Jason Schubert 11/20/06 11:22 AM >>> Molly, As I mentioned at the banquet, the owner and applicant are seeking to reduce the amount of square footage considered to be a "night club" so that parking is not impacted as much for the undeveloped Phase 2. Retail is a second use of the business. Two possibilities were offered; 1) not consider the storage/office room square footage or 2) as part of the CUP have Council limit the square footage to a specific amount. I told them I would ask since I was not familiar with other CUPs and I wanted to be consistent. I believe you mentioned that the entire square footage would need to be part of the CUP. Planning is ok with a temporary CO for a retail use until the CUP is decided. She mentioned that wine would be sold by the bottle and by the glass along with the possibility of some entertainment a few times a year. With selling by the glass for on-premise consumption or the presence of entertainment, the use would be defined as a night club/bar/tavern instead of retail. All such establishments outside of NG-1, NG-2, or WPC zoning districts must obtain a Conditional Use Permit.
