The site plan from Kling Enginering that I reviewed and addressed in a letter to David Scarmardo dated November 13, 2002 had indicated impacts to the forested depressional wetland identified in the PJD report as the northeastern depressional wetland with approximate area of 0.05 acre and impact to the ephemeral tributary of approximate area of 0.002 acre and 90 linear feet. Since the total impacts were less than the 0.1 acre and the 300 L.F. thresholds requiring pre-construction notification, nothing was submitted to the USACE. Based on the proposed impacts, the development was authorized under nationwide permit 39 without USACE review. The 404 permit for the Gateway retail center addressed the impacts to the ephemeral tributary on the eastern side of the retail center property as a result of the construction of the detention basin. A modification was made to that permit to allow three storm culvert discharges to the detention pond from the Gateway Villas development tract instead of the one originally permitted, but that permit did not address any of the impacts to jurisdictional areas on the Gateway Villas development tract. Any proposed additional fill of jurisdictional areas on the Gateway Villas tract that would exceed the pre-construction notification thresholds stated above would require submittal of a 404 permit application to the USACE for review Loretta E. The reason we are asking for that is to see if the corp in the permit stated that the two wetland areas near the sewer line can be filled You will note that these two small jurisdictional wetland areas near the sewer easement are shown on the plan that you emailed me. Does the existing permit allow for the filling of these wetland areas? If a developer wants to fill them what (permitting wise) do they have to do to get a corp permit to fill them?
