As I understand it the drainage easement was dedicated when the Ggtent was to realign the channeLObviously this has not
.baappened and I don't believe that it is my client's intent to pursue this course of action. It appears that the easement
alignment was determined by pretty much simply connecting the downstream end to the upstream end with only one bend,
therefore, a significant portion (of the upstream end) of this drainage easement is encumbering ground this is outside of the
floodway. Graphically the "good"ground is in the floodplain, but I believe this is in error since the lowest elevation in this area
is 9' above the creek flowline (HEC-RAS model illustrates flows in the creek to be approximately 4.5' to 5' deep during the 100-
year flood).
