REQUEST: Appeal of the Zoning Official's Interpretation. The applicant proposed a
sign for the subject site that does not meet the sign regulations in the
Unified Development Ordinance.
LOCATION: 1063 Texas Avenue
Lots 11 & 12, Block 3, College Hills Subdivision
PURPOSE: To allow the proposed sign, a 3D chili pepper, to be installed on the basis
of a different interpretation of the sign regulations.

ITEM BACKGROUND
The sign contractor for the Chili's restaurant submitted a Sign Permit Application in July 2007.
The sign package was part of a remodel of the restaurant. All proposed signs, 150 square feet
of attached signs and a 75 square-foot freestanding sign, were permitted and installed except
for a 3D chili pepper. The 3D chili pepper was proposed to be attached to a canopy support
facing Texas Avenue, would be 32.25 square feet in size, and would extend 4 feet from the
canopy support to which it would be attached.
Unified Development Ordinance (UDO) Section 7.4.l.6.d states that an attached sign "shall not
extend more than one foot from any exterior building face, mansard, awning, or canopy." Since
the 3D chili pepper extended 4 feet from the structure to which it is attached, that portion of the
sign permit was denied. The applicant is requesting this Administrative Appeal due to the denial
of that portion of the sign permit (a building permit) as based on interpretation of UDO Article 7,
General Development Standards.
