SUBJECT: Rezoning application of the McCrory Tract along the north side of Harvey
Mitchell Parkway.
Attached is the rezoning application for the McCrory tract located on Harvey Mitchell Parkway.
We understand that the concept plan we are submitting may change drastically before going to
the Planning & Zoning Commission. We just received a letter from Dr. O'Connor late Friday
afternoon requesting several items that should be included on the concept plan. We have a
tentative meeting scheduled with the homeowners on Wednesday, November 14th to discuss
the concept plan and their requested changes. Our goal is to take the comments from the
homeowners and the comments from City staff and make one round of changes before going to
the Planning &Zoning Commission meeting.

Good afternoon,
I just wanted to follow-up with everyone regarding the Dove Trails apartment complex. Over the last year, we have worked with
the new owner of the McCrory tract, Mike Butte in an effort to develop the property. We have had numerous meetings with the
surrounding property owners to negotiate a Concept Plan. Unfortunately, after the last neighborhood meeting, Mr. Butte decided
to not move forward on the apartment complex development. As you will recall, there were neighbors that opposed apartments
completely, there were neighbors who preferred the commercial/townhouse proposal; and, neighbors who preferred the
apartments given the Concept Plan we proposed. Mr. Butte has decided that he needs to move forward to develop the property
and will keep the current zoning on the property. The existing zoning is C-3 Commercial in the front along Harvey Mitchell and R-
3 Townhomes in the rear. As long as Mr. Butte follows the City's development regulations, there will be no additional public
hearings- he will simply follow the administrative Site Plan process.
Although we did not reach a final agreement, I truly appreciate your willingness to meet in the evenings to discuss the Concept
Plan. Have a great day!

RE: The McCrory Tract
Thank you for the update. Mr. Butte called me last week and asked me to look over your
plans, and I will be pleased to do so at your earliest convenience.
I cannot speak for the other neighbors, but I was one of those who said to the City Council
that things were moving too fast. I also said, and still heliev e, that tiling a concept plan
BEFORE completion of consulting k,ith the neighbors is the wrong approach. It is my- hope that
you gill not tile, or the Planning and Zoning group will not accept, am, plan that does not
incorporate as many of the legitimate neighborhood concerns as possible. In order for that to
happen, a meeting must he held well in advance of isrry plan submission. WW ith r Collo\\'-up
meeting on revisions, again prior to plan sulgnission.
In that respect, I urge you to consider the possibility of retaining the present zoning and
attempting to maximize profits from town homes, rather than more dense housing. Most of the
anticipated problems (sewer adequacy, traffic noise and congestion, increased runoff to
neighboring properties and/or to Bee Creek, light intrusion, etc.) are associated v ith high density
housing.
Since it is my understanding that the number of units per acre could be greater under a
planned development approach than for normal zoning, I also hope that you will consider selling
to me (and/or other neighbors), at a mutually agreeable price, a buffer zone of trees and brush
sufficient to give reasonable protection to the Angelina and Augustine neighborhoods. That
would provide permanent protection against changes in plans by present or future owners.

Not at the moment.
We have sent comments back to the architect to revise the concept plan and hope to get that back next week. Then
we'll send it to the guy who will do the 3D visualization. That will take another week.Then we'll send graphics and
concept plan out to the property owners for comments and to see if they want to meet. We'd like to make the Dec.
31 deadline if we can. There are a lot of variable but that's what we are shooting for right now.
We notified the property owners yesterday and gave them an update of where we are.

together.

Good morning,
I wanted to thank everyone who attended our second neighborhood meeting at the Conference Center and the City
Council meeting on 11/26 for the Comprehensive Plan Amendment. Since that time,we've made it through the
Thanksgiving holiday with family and friends and recovered from celebrating the Aggies beating T.U. (Whoop!)
The purpose of this e-mail is to update you on the status of our project. We are in the process of re-examining the
design and layout of the development based on input we received from the last neighborhood meeting. We
discussed several modifications to the site that are being incorporated into the Concept Plan that will be submitted
with the rezoning request. At the November 26th Council meeting, several citizens expressed concern that the
project was moving too quickly. The neighborhood wanted more time to work out the specifics of the Concept Plan
before considering the rezoning request. Here's where we are to date:
• We have delayed our rezoning application asking the City to place it on hold until we are able to
analyze and discuss the details of the Concept Plan. If possible,we would like to meet the deadline of
December 31st to get the rezoning scheduled for the Planning and Zoning Commission meeting on
February 7th and City Council on February 28th. That doesn't mean that we have to have every detail
worked out by December 31st; but,we should have the outstanding issues limited to a few. This gives
us the month of January to iron out any unresolved issues.
• We are making the final changes to the Concept Plan now. We're in the process of documenting
what we have agreed to through notes on the Concept Plan itself. Our goal is to e-mail you a copy of
the plan by late next week.
• At our last neighborhood meeting, someone suggested putting together a graphic of how the new
development will look from the adjacent single family homes on Angelina and Augustine given the
topography, buffering,fencing and building locations. We have hired a graphics specialist who will
prepare these images that we will share with you as soon as they are available. Those of you on
Angelina and Augustine may see Jane Kee or me walking around with a camera in the next few days.
We need to provide some baseline photos to the graphics specialist. We hope to have these images
available the week of 12/17 for your review.
• I've updated the e-mailing list from the last neighborhood meeting and I've added addresses that
you've sent me. Please review the e-mail list and let me know if there is anyone else that I should
include for future e-mails.
I want to thank you all again for being willing to have an open dialogue about the development of the McCrory tract.
I will forward the Concept Plan and Graphic Representations as soon as they are available for your review and
comment.

Thank you for your question. I need a little more clarification though. Are you looking for which properties are
within the 200' boundary or names and addresses of the owners of those properties?
If just the boundary, I have attached a small area map and aerial that may be helpful.
If the names and addresses,that would be a Public Information Request associated with the Open Records Act. I
have attached the page that you would need to fill out and return. So you know,the project number for the
rezoning request is 07-290. As for cost for that,you'd pay a whopping 10 cents/page. Let me know what you need.

Good evening,
I wanted to let you know that we have finally completed the changes to the Concept Plan that we discussed at our
last meeting. From that revised plan,we have developed a video showing the impacts of the revised Concept Plan
and what the project will look like from the adjacent neighborhoods. We would like to invite you to a meeting on
Wednesday, March 5th, 2008 at 7:00 p.m. at the Conference Center on George Bush Drive in College Station. At that
meeting, we will present the revised Plan, show the video and answer any questions you may have regarding the
project.
Please let me know if you will be in attendance. I apologize for the short notice. We originally planned on Thursday
evening; however,there is a Planning&Zoning Commission meeting in which City staff has to attend. We thought
about postponing the meeting to the following week; but,were afraid that too many homeowners would be away on
Spring Break.
We are anxious for you to see our progress and determine whether or not we have adequately addressed your

It was my understanding that long before any concept is presented to the city, neighbors would be invited to
participate in the plan, after which they would see the "citizen-approved"version before final submission.
If that is the purpose of the upcoming meeting, great!
However, if this is just going to be another meeting to hear what WILL be presented to the city, I will be strongly
opposed, and I hope that my fellow neighbors will feel likewise.
In order for a new plan to be considered, major issues that HAVE to be addressed include:
a. How will the impact of lights, noise and congestion be minimized?
b. What changes will accommodate the existing flood area, since that clearly will not have been taken out of a
flood zone yet?
c. What absolute assurances can be given that no runoff to the neighbors will occur?
d. How will traffic in and out of the development be accommodated without traffic jams at critical intersections?
e. What is the capacity of the sewer to be tapped into, and how much more can that line accept?
f. What absolute assurance can be given that any"buffer zones"will be honored by future owners?
There are probably other issues, but all of the above must, I believe, be part of any properly"planned
development".

Subject: Density calculations
Natalie,
I wanted to follow up on our phone conversation yesterday. The area that can be used for calculating density is only
the area within the zoning district in question. A property may have any number of zoning districts within it but the
density of a particular zoning district(in this case a PDD) is based off the number of dwelling units within the acreage
of that district.
For the McCrory tract,a Floodplain &Streams land use area remained on the property as part of the Comprehensive
Plan Amendment adopted in November. The area planned for PDD residential development is the area that should
be used to calculate the density. Any areas outside of the Floodplain &Streams designation could be requested to
be rezoned and used for a density calculation. Let me know if you have any questions.

Hey Jason,
Could you please point me to the section of the code that backs this up?I'm sorry Jason but I'm really confused by
this interpretation.
We have a comprehensive plan that has a very general location for floodplains&streams. The intent was to have
these green areas match up with the 100 year floodplain. Since that time,we now have a staff that"scales"off the
very general land use plan for literal locations of"green"areas. We also have a City Council that won't allow you to
rezone the areas just outside the floodplain -they want more open space"just because". Land owners are forced to
give up more and more open space as part of their overall development plans. Now you're telling me that we can't
calculate these"preserved" areas into the overall density calcs. At what point does all of this become a taking? Can
this also be interpreted to remove public streets, drainage easements, landscape buffers,etc. from the overall
calculations?
Are you telling me that in such developments like 2818 Place Apartments(the project in which the City Council
denied them the ability to align the zoning boundaries with the LOMR approved floodplain boundaries)that they did
not receive any credit for the A-0 property? They own it,they're responsible for maintaining it but then you further
limit the density because it's zoned A-O.
Jason, I know that I'm hard-headed at times(some will say more than others); but, I just don't understand this
interpretation. Please let me know what my options are this point.

Natalie,
I just wanted to follow up on your e-mail. I think there is some confusion. We are not requiring anything to be
changed on your plans we are simply pointing out how we will present the density information to P&Z and Council.
Please keep in mind that we are in the rezoning (i.e., legislative) stage of this process and that items such as
appropriate density, sufficiency of buffers, layout, etc are all still very much in play and subject to negotiation. The
only thing that has been determined to date is that what ever development occurs on the property may develop as a
planned development.
As to the comment regarding Place Properties(which was a site plan approval)their approved density is actually
below the permitted dwelling units for the non A-O portion of the property. As to the other comments I'll leave those
for a discussion for another day since they appear to be more philosophical than anything else.
I trust that this helps provide a bit of clarification and would be happy to discuss any of this further with you.

Natalie-
Since the question came up Wednesday night about runoff water, and I was asked if I was an engineer, I though it
might be helpful for you and other interested parties to look at the following information,which is not"engineering",
but which has a little basic math and a bit of common sense:
If anyone doubts that water will run off more from a "roofed-and-concreted" area than it will from natural soil, I
invite them to pour a bucket of water on some of their sloping land and pour another bucket on part of their sloping
concrete driveway.
As just one, highly conservative example, consider the possibility of comparing the proposed 6 acres of"roofed-
and-concreted" area with 6 acres of natural land in the"McCrory Tract".
*Assume that the runoff would be the same for both after enough rainfall to saturate the ground.
*Then the DIFFERENCE would be the runoff before the ground was saturated.
*Assume that a rainfall of one inch per hour for two hours would saturate the ground. (It would probably really
take more.)
*Then two inches(1/2 foot)on the six acres of"roofed-and-concreted" area would be one acre-foot of"extra"
water.
*One acre-foot is equal to about 326,000 gallons-and that is the EXTRA RUNOFF.
*Over two hours that is equivalent to about 2,700 gallons per minute(about the flow of 45 full blast fire hoses for
two full hours).
If anyone finds a mistake in my arithmetic, please let me know and I will apologize. After all, I'm not an engineer.

A rezoning application was turned in on November 12th (McCrory Tract,file 07-290). It was put on hold when
Council asked that you work with the neighborhood on the concept plan prior to proceeding. With the fees paid, you
can submit the revised concept plan and any other revisions you want in order to proceed to the P&Z meeting for the
deadline you meet. Let me know if you have any questions.

Subject: Dove Trails Rezoning Request Withdrawn
Good afternoon,
I just wanted to follow-up with everyone regarding the Dove Trails apartment complex. Over the last year,we have
worked with the new owner of the McCrory tract, Mike Butte in an effort to develop the property. We have had
numerous meetings with the surrounding property owners to negotiate a Concept Plan. Unfortunately, after the last
neighborhood meeting, Mr. Butte decided to not move forward on the apartment complex development. As you will
recall,there were neighbors that opposed apartments completely,there were neighbors who preferred the
commercial/townhouse proposal; and, neighbors who preferred the apartments given the Concept Plan we
proposed. Mr. Butte has decided that he needs to move forward to develop the property and will keep the current
zoning on the property. The existing zoning is C-3 Commercial in the front along Harvey Mitchell and R-3
Townhomes in the rear. As long as Mr. Butte follows the City's development regulations,there will be no additional
public hearings- he will simply follow the administrative Site Plan process.
Although we did not reach a final agreement, I truly appreciate your willingness to meet in the evenings to discuss
the Concept Plan. Have a great day!

Natalie, I looked up the fees in UDO 3.1 to see what it said. It says that fees for map amendments,which includes
rezonings,are not refundable. One other thing to mention from your email to the neighborhood was the reference
about the site plan process. As you remember the property would need to plat as well in order to develop. Let me

I was sorry to receive your call yesterday with the statement that you would be cutting down all the trees now
serving to protect our property. When you and I first met,I told you that I would have to oppose any threat to the
value of our property or to our right to privacy and enjoyment of our property. At that time,you told me that you
did not want to"get into a fight". Later,after you visited our home,you told me that you would protect our
property.
I don't know whether your latest phone call was on the basis of"good business"or a "punishment"for my
opposition to some of your plans.
I would still like to resolve the issues in an amicable manner,and I am therefore asking you to consider selling to
me and/or a group of neighbors a strip of your property about 60-75 feet wide extending from the creek up to the
bend in the property line. I think that is about 0.6 acre or so. If you would consider that, please quote me an asking
price.
It is my understanding that the fire code limits you to 30 townhouse units if you only have a single access road,
and that the requirements for a second,gated, access would be difficult to meet. In addition,the area we are
interested in is a potential runoff water problem for you,and its sale and preservation as a natural area would add to
the value of your town homes.
I do not want to get into litigation, but I am prepared to do so, and would be willing to discuss the basis for such
with you if you are interested.
The third possibility is for you to retain ownership of the whole property, but to keep a 75 foot barrier as most
recently proposed. A contractual agreement to that end could also resolve our problems.
I will look forward to hearing from you.

I'm sure that language was put in the UDO for a reason. As you know, a lot of staff time is involved at the initial time
of the submittal; we create file folders and input all the project data into the HTE electronic files, it's forwarded for
the creation and input of the CS address,then it's forwarded to create the SAM and aerial,then it's forwarded to
record all of the documents and/or plans that were submitted onto the Ledger,then we put it on the New
Development List,then it's put on the Tracking Sheet and Council Agenda Planning calendar ... and this is all done on
the day it's submitted! So, it is processed by six staff members before it even gets to a Planner for review.And,yes,
I hope we're following the UDO.

Subject: The McCrory Tract
After receiving the threat from Mike Butte that they were going to cut down all the trees and brush on the McCrory
tract in the area opposite to our home,we hired an attorney and filed a motion for a Temporary Restraining Order,
Temporary Injunction,and Permanent Injunction to prevent cutting of trees and brush in an area 60 feet from the
north boundary if the tract.
The Temporary Restraining Order was granted and is now in place.
Mike Butte has now hired a local attorney and a motion for a thirty day extension of the TRO has been filed.
We will attempt to negotiate some agreement to protect the Angelina and Augustine neighborhoods from loss of a
buffer zone along the drainage area in order to reduce the potential for runoff water into that area.

SUBJECT: MCCRORY TRACT (REZ) - Rezoning
Staff reviewed the above-mentioned rezoning application and determined it to be insufficient
and will not therefore be scheduled for the December 20th Planning & Zoning Commission
meeting. As stated in your cover letter, the Concept Plan was submitted incomplete and it is
also not in accordance with the application checklist.
In keeping with direction given by City Council at its November 19th meeting, the neighborhood
is to have sufficient input into the concept plan well before the item being presented to the
Planning & Zoning Commission. Staff is committed in helping facilitate the process by providing
meeting space in the College Station Conference Center and I continue to offer my assistance
in scheduling that meeting space. Please continue working with the adjacent neighborhood,
making sure all interested parties are included in the process. Once those additional contacts
have taken place, submit the proposed Concept Plan and revised application (as necessary) for
review. Staff will continue to reserve our full review period at that point as it relates to the item
being scheduled for the next available Planning & Zoning Commission meeting.
