MINIMUM SUBMITTAL REQUIREMENTS
If a petition for rezoning is denied by the City Council, another application for rezoning shall not be filed within
a period of 180 days from the date of denial, except with permission of the Planning & Zoning Commission.
Thefollowing items must be submitted by an established filing deadline date for consideration:
Application completed in full.
$500 Rezoning Application fee.

1/ Two (2) copies of a fully dimensioned Rezoning Map on 24"x 36" paper showing:
a. Land affected;
b. Legal description of area of proposed change;
c. Present zoning;
d. Zoning classification of all abutting land; and
✓ e. All public and private rights-of-way and easements bounding and intersecting subject land.
Written legal description of subject property (metes & bounds or lot & block of subdivision, whichever is
applicable).
V Fourteen (14) copies of the Concept Plan in accordance with Section 3.4.D of the UDO (see attached
checklist).
t_ Proof that the Greenways Manager has reviewed and approved your Concept Plan, if applicable.
Proof that the Parks and Recreation Advisory Board has reviewed and approved your Concept Plan, if
applicable.

SUPPORTING INFORMATION
List the changed or changing conditions in the area or in the City which make this zone change
necessary:
1) TxDOT has more stringent access policies now than when the property was previously zoned. They
will no longer allow direct and permanent access to Harvey Mitchell Parkway (2818). This poor access
precludes retail commercial from being viable.
2) The Bee Creek channelization project has been completed to eliminate the flooding problems that had
occurred in the area. Approval of the LOMR is pending. CLOMR indicates that floodplain will be
contained within the Bee Creek channel.
Indicate whether or not this zone change is in accordance with the Comprehensive Plan. If it is
not, explain why the Plan is incorrect:
Yes, it is in compliance as the plan shows Planned Development as the accepted land use.
List any other reasons to support this zone change:
1) The attached residential classification enables multi-family development to occur closer to the
University rather then occurring on the periphery of the city.
2) This change enables a rezoning that will eliminate the existing C-1 zoning that would result in a typical
strip commercial development. This location is inappropriate for general commercial zoning due to its
inadequate depth and the lack of a major intersection.
Explain the purpose and intent of the proposed development:
The purpose of this PDD is to enable a low density multi-family development, not to exceed R-4 density
over the 7.60 acre tract. The concept plan shows that the property will develop in such a way as to have
minimal impact on adjacent single family residential areas by reconfiguring the current 1.55 acres of A-0
zoning to better provide a separation from the homes along Angelina and Augustina Courts from the multi-
family residences. The homes on the other side of Bee Creek will also continue to have some open space
beyond the creek channel.
3) What is the range of future building heights: Maximum building height of 35'.
4) Provide a general statement regarding the proposed drainage: Drainage will be designed to not impact
any of the existing residences and most likely will be designed to flow directly into Bee Creek.

5) List the general bulk or dimensional variations sought: None. All current neighborhood protection
standards and other applicable UDO standards will be met.
Please note that a "complete site plan" must be submitted to Planning & Development Services for
a formal review after the "concept plan" has been approved by the City Council prior to the
issuance of a building permit—except for single-family development.
