VARIANCE REQUEST
The following specific variation from the ordinance is requested:
To authorize a 24" roof overhang on the zero -lot -line side of dwelling
This variance is necessary due to the following special conditions:
At the time this lot was purchased (1997) the Easements, Restrictions and Covenants
granted a 24" aerial easement for the purpose of allowing the eaves to occupy this
easement (excerpt attached). In good faith and consistent with this provision we had
our home professionally designed specifically to include a 24" roof overhang on the
zero -lot -line side of the dwelling.
The unnecessary hardship (s) involved by meeting the provisions of the ordinance other
than financial hardship is/are:
Without this roof overhang the home will look peculiar, the design esthetics will
disappear and much of our design expenses will have been lost. Also moving the
house 24" inside the zero -lot -line would violate other covenants, create serious fencing
problems and reduce the outdoor living space on the other side of the lot.
The following alternatives to the requested variance are possible:
The only alternative is to redesign the house.
This variance will not be contrary to the public interest by virtue of the following facts:
_ Twelve of fourteen homes on our street have utilized this easement to a certain extent
and our home will look peculiar and "not fit in" with our neighbors if no overhang is
— permitted.
Because the dwellings are separated by 15 feet, there should be no safety, problem
— with our zero -lot -line neighbor.
The applicant has prepared this application and certifies that the facts stated herein and exhibits

Restrictions and Covenants for Phase Two Section A
of the Pebble Creek Development, 1995
3. The Supplementary Declaration as recorded in Volume 2068, Page9:,,

amended by adding Section 6.4 which shall read as follows:<<' L:

"An Aerial Easement is hereby granted and/or reserved; as:�
the case may be for the benefit of the adjoining lot,
twenty-four (2411) inches in width adjacent to and along sy:
the side lot line on that portion of each lot that is
located in the patio or open space area of such lot. The
Aerial Easement is for the purpose of allowing the eaves
of a residence or garage constructed on the adjoining lot
to occupy the aerial space within such twenty-four (2411)
inches. The Aerial Easement shall not be located within
eight 8feet of the surface oft the ground, and it shall ."�.,_
extend in height six inches above the surface of the.
roof. In addition to the Aerial Easement, a construction
easement is hereby granted to the owner of the adjoining
lot allowing such person to cross the yard, patio or
other open space of a particular lot for the purpose of
constructing the eaves or overhang of the house that is
the beneficiary of the Aerial Easement and making repairs
or maintenance to the eaves located within the Aerial
Easement. Any access to or use of the construction
easement shall only be between the hours of 8:00 a.m. and _
5:00 p.m. on normal business days. The Architectural
Control Committee shall have the right to impose
additional limitations on the right to use such
construction easement if the Architectural Control
Committee deems necessary. Any person or party using R
such construction easement shall be liable to the owner
of the lot over which such easement is granted for any
damages that may occur to the servient estate."
