TxDOT: All comments seem to be for information only - no plat changes required. ENGINEERING: 1) The construction plans will be revised to reflect the current right-of-way. 2) •BTU subordination - Per Mark Smith and Craig Jordan, BTU will not require subordination to allow the right-of-way to encroach into the BTU easement. •Aquilla Southwest subordination -The developer is working with ETC (the current owner of the easement)to abandon this easement. The agreement should be finalized prior to filing. 3) Conservation easement encroachment - The agreement with TxDOT does provide for minor encroachments. The developer is pursuing a letter kohl TxDOT indicating approval. It is my understanding that the existing 24"waterline along Highway 40 is in fact inside the TxDOT ROW and the City of College Station does not even have an easement for this waterline. You might confirm this. So, you will be on TxDOT's properly when the 12"waterline is connected to the existing 24"waterline. I spoke with Rick Conlin and he sent you the geotechnical report for the roadway. He has recommended 7" pavement, but we used 8" pavement as this is the minimum-please verify. So, tell me if the following scenario is happening or not. I am not submitting the City street plans to TxDOT. Therefore, I am taking the 40/Arrington apron in TxDOT's ROW off my CIP street plans. No. Don't take anything off the plans. This is being submitted to TxDOT as if the developer were platting and developing this property. They will submit the site development plan to Ken and then Ken will send it on to the State just as if they were platting and developing this site. 2. So,we agree that the waterline on my Arrington/Decatur Road plans shown as by others will not be constructed by anyone from that set of plans. I am not directing Walter P. Moore on anything about the waterline, but I am going to tell them that because the waterline is not on the CIP project's plans that the waterline construction drawings must be submitted to Development Services for approval and construction and will not be bid with the Decatur/Arrington road plans. You don't have to tell them anything about the waterline plans. They are part of their site development plans and they should go to Development Services because that is who reviews all site development plans. 3. I have no comment on the bidding scenario, but I assume we(the City)will give Walter P Moore/owner a list of the bidders. I have nothing to say about the waterline plans during my bidding process to the bidders. I also do not want to be the one to even tell Walter P. Moore about how to do this. Last but not least, I do not see how the attached scenario you mentioned keeps the contractors from sticking it to them. They could bid the street low and the waterline high, because they know the waterline has to be built. Also,what if one contractor is very low on the waterline and a different contractor is low on the street bid. I am going with the low bid for the street regardless of the waterline bid. We will award to the low bidder on the street project and will give no consideration to the waterline bid. I like your position on our just providing WP Moore with the bidders list and leaving it up to them to gather bids for the waterline. We don't need to include any discussion of the waterline in our pre-bid meeting. There is nothing really that will keep the contractors from sticking it to the developer on the waterline. City Engineer, Public Works S WALTER P MOORE August 16, 2006 Mr. Mark Smith Director of Public Works City of College Station 2613 Texas Ave. South College Station, TX 77842 Re: Arrington Road & Decatur Road Infrastructure Development WPM Project: 23.06003.00 BTU Easement Dear Mark: In the conceptual stage of this project it was agreed by the City and Walter P Moore to match the alignment of existing Arrington Road and to avoid the detention pond to allow for a volume for volume pre/post construction exchange. It was also pointed out at this time that the 80' Right of Way(ROW)overlapped a 60' BTU easement and a 30' ETC easement. We pursued both companies shortly thereafter to form a basis for agreements. We are still in talks with the gas company (ETC), but have received written acceptance from BTU to put our proposed ROW and roadway improvements within their easement. I have enclosed this correspondence for your review. The following are the proposed areas of encroachment: • 10-feet of the roadway Right-of-Way encroaches into the BTU easement • The sidewalk, waterline, and sidewalk portion of the bridge will be within the easement • No other structures or utilities that run parallel to the overhead utilities are proposed within the easement • The typical horizontal clearance from the waterline to the utility poles is about 20' • At the roundabout intersection the clearance from the waterline to the face of pole is 10' • Both Arrington & Decatur Road cross underneath the transmission and distribution lines with adequate clearance In our opinion, BTU will not subordinate their easement, therefore we recommend moving forward on the project with BTU's aforementioned approval. The one clearance (19.36') is to a foreign utility cable and you will need to get with that utility for them to answer your clearance requst. BTU is okay with sidewalks within the easement area and street intersections. It is our understanding that there will be no structures (lights poles, signal light poles, etc)with the easement area. As discussed during our meeting on 6-19-06 we established a minimum vertical clearance of 22'from an overhead electric line to the crown of the roadway. This minimum vertical clearance is met at all three locations where the proposed road crosses under the utilities.
