ten foot(10') setback from the right-of-way line to the parking area. This additional setback
requirement shall not apply if the proposed building(s) resides in an existing overlay district."

GENERAL VARIANCE REQUEST
The following specific variation from the ordinance is requested:
Allow six foot(6') setback from the right-of-way line to the parking area along Texas Avenue for Phase II
improvements.
This variance is necessary due to the following special conditions:
Special Condition Definition: To justify a variance, the difficulty must be due to unique circumstances
involving the particular property. The unique circumstances must be related to a physical characteristic of the
property itself, not to the owner's personal situation. This is because regardless of ownership, the variance will
run with the land.
Example: A creek bisecting a lot, a smaller buildable area than is seen on surrounding lots, specimen trees.
Note: A cul-de-sac is a standard street layout in College Station. The shape of standard cul-de-sac lots are
generally not special conditions.
• Since the building cannot be moved further back on site without adversely affecting motor bank
stacking, a ten foot setback would necessitate narrowing the drive aisle by four feet which would
make it much more difficult for city fire and emergency vehicles to maneuver between Copy
Corner center and the curb cut on Manuel Drive.
• A six foot setback would be consistent with that of the adjacent Copy Corner center,which whom
we share a reciprocal access drive, allowing said drive and parking spaces to line up evenly. This
would be preferable from both a maneuverability standpoint as well as enhance the architectural
congruity of the two properties, part of our overall design goal.
The unnecessary hardship (s) involved by meeting the provisions of the ordinance other than financial
hardship is/are:
Hardship Definition: The inability to make reasonable use of the property in accord with the literal
requirements of the law. The hardship must be a direct result of the special condition.
Example: A hardship of a creek bisecting a lot could be the reduction of the buildable area on the lot, when
compared to neighboring properties.
• City fire department would have difficulty using the drive aisle as a fire lane.
• Would require either a reduction of building square footage below feasible level (especially given
narrow width of property) or a reduction in motor bank stacking.
The following alternatives to the requested variance are possible:
None.
This variance will not be contrary to the public interest by virtue of the following facts:
• Allows use of site as a branch banking facility, a highly beneficial use to the neighborhood.
• Enhances public safety by allowing greater turning radius in drive aisles for fire and emergency
vehicles.
• By having the property architecturally congruous with adjacent Copy Corner center,with which
we'll share a reciprocal access drive, the spirit of the NRA Standards is better achieved.
