GENERAL INFORMATION Status of Applicant: Home builder Property Owner: Kabricia Tucker Applicable Ordinance Section: Section 5.2 Residential Dimensional Standards PHYSICAL CHARACTERISTICS Zoning and Land Use • Subject Property: R-1 Single Family Residential, Single family house • North: R-1 Single Family Residential, Single family house • West: R-2 Duplex Residential, Duplex • East: R-1 Single Family Residential, Single family house • South: R-1 Single Family Residential, single family house Frontage: Approximately 50' of frontage on Arizona St. Access: Site survey indicates access via Arizona St. Topography &Vegetation: Relatively flat with some vegetation Flood Plain: Not within the floodplain. VARIANCE INFORMATION Background: This case involves an error made by the builder in establishing the 7.5- foot side setback. The result is an encroachment that reaches 6.5-feet from the property line to the closest part of the home; thus the applicant is requesting a side setback variance of 1 foot. ANALYSIS Hardship and Special Condition: Originally platted in 1946, the lines that indicate lot ownership have shifted over the years from the original platted lot lines. The applicant states that the "configuration of the lot is slanted in such a way that there is extreme difficulty in building a house in the area." Alternatives: The applicant offers no alternatives. Recommendation: Staff recommends approval of the variance. SPECIAL INFORMATION Ordinance Intent: Building setback requirements usually allow for some degree of control over population density, access to light and air, and fire protection.
