Horton, Inc. engaged MACTEC Engineering and Consulting,Inc. (MACTEC) to perform a Phase I Environmental Site Assessment (Phase I ESA) of the above referenced property. This study was authorized by Ms. Diane Czarnecki and confirmed by issue of MACTEC Project Order 9743010 on May 26, 2005. PROPERTY DESCRIPTION 1/4/2006Received Time Apr. 26. 3: 27PM NPR. 26. 2006. 4: 41 PM(Ar ^R NORTON summary _ 4906-05-9743-r No RECs O. 3067 1P. 32 of The subject property consists of 47.97 acres of land located along North Forest Parkway in College Station, Brazos County, Texas. The subject property is reportedly being developed by an outside contractor, with lots to be purchased by DIR. Horton upon completion of development. The subject property, which is identified as the Fojtik Property (AUS), is located in the vicinity of the latitude 30.61701 degrees north, and longitude—96.28455 degrees west. SITE RECONNAISSANCE The site and area reconnaissance was conducted by Mr.Andrew Sutton on June 7, 2005. The subject property currently consists of undeveloped land with two dilapidated sheds and the remains of natural gas well drilling site. The subject property is surrounded by residential development to the north, a waste water treatment plant to the east, residences to the south across North Forest Parkway, a church to the southwest and a commercial facility to the west. MACTEC's site reconnaissance did not indicate recognized environmental conditions (RECs) to the subject property. HISTORICAL REVIEW The 1960, 1979, and 1987 aerial photographs show the subject property as p-ri,Tr�s if undeveloped land, . -- with two small structures on the southern portion of the site, with a stream crossing the northern, wooded portion of the property. The 1996 and 2004 aerial photographs the subject property as primarily undeveloped land, with two small structures on the southern portion of the site, a stream crossing the northern,wooded portion of the property, and a rectangular cleared area located on the eastern portion of the property. Sanborn maps or city directories were not available for review for the subject property as it has existed as undeveloped land. The 1960 aerial photograph shows the surrounding properties as primarily undeveloped land to the north, east, south and west, with a utility easement along the northeastern property border. The 1979 aerial photograph shows the surrounding properties as residential to the north, a waste water treatment plant to the east, undeveloped land to the south and west, with a utility easement along the northeastern property border. The 1987, 1996, and 2004 aerial photographs showed the surrounding properties as residential to the north, a waste water treatment plant to the east, residential to the south, a church to the southwest, a commercial facility to the west, and a utility easement along the northeastern property border. Based on the history of the surrounding properties, they are not considered RECs. MACTEC discussed the condition of the subject property with Mr. Steve Arden, Representative for Brazos Land Realty (Seller/Developer). Mr. Arden stated that he was not aware of conditions which may pose an environmental concern for the subject property. REGULATORY REVIEW MACTEC's review of the regulatory agency information and area reconnaissance did not indicate sources of environmental concern to the subject property. R NORTON— Summary-4906-05-9743-0' No RECs NO. 3067 P. 43 of 4 During our site visit, MACTEC observed what appeared to be the remnants of a natural gas drilling operation located on the eastern portion of the property. This area was identified in the aerial photograph review as a rectangular, cleared area. Additionally, a small concrete pad, which may have been a former generator mount, was observed on the subject property in this area. MACTEC reviewed the Railroad Commission of Texas (RRC) Well Location Map for the subject property. No wells were indicated on the RRC map and no wells were located on the subject property in the regulatory report. No evidence of drilling mud pits were observed on the subject property during the site visit, and no visual staining or stressed vegetation resulting from the former drilling operation was observed during the site visit. Mr. Arden confirmed the existence of the gas well site. However, Mr. Arden stated that the he was not aware of environmental conditions which could represent a recognized environmental condition for the subject property. As a result, the former natural gas well drilling site is not expected to represent an environmental concern for the subject property. However, in the event that natural gas wells are located on the subject property and are not intended for future use, MACTEC recommends that they be properly plugged and abandoned in accordance with regulatory guidelines. MACTEC did not observe on-site RECs to the subject property. OFFSITE CONDITIONS MACTEC did not observe off-site RECs to the subject property. CONCLUSIONS AND RECOMMENDATIONS MACTEC performed thiF assessment in general conformance withthescope and limitations of American Society for Testing and Materials (ASTM) E 1527-00 of the subject property identified above to identify any RECs, in connection with the property, including the presence, or likely presence, of any hazardous substances or petroleum products on the subject property under conditions that indicate an existing release, a past release, or a material threat of a release into the ground, groundwater, surface water, or structures on the subject property, This assessment included an evaluation to the extent practicable of the past and present land uses at the subject property and on adjacent properties. The results of this assessment have identified no evidence of on-site or off-site RECs. The following potential development issues were identified: Natural gas pipelines were observed located along the northeastern property border and along the southeastern property border during the site visit and during the aerial photograph review. In the event that natural gas wells are located on the subject property and are not intended for future use, MACTEC recommends that they be properly plugged and abandoned in accordance with regulatory guidelines. Two dilapidated sheds and a wooden fenced area were observed on the subject property during the site visit. The sheds appeared to be primarily of wood and metal construction., with a small amount of roofing shingle associated with the smaller of the two sheds. No hazardous materials were observed associated with the sheds during the site visit. However, based on the age of the structures, the roofing materials may potentially be asbestos containing material and should be removed and disposed of in accordance with regulatory guidelines. Based on MACTEC's review of the National Wetlands Inventory (NWI) Map, one potential jurisdictional wetland area was located on the wetlands map which was reviewed for the subject property.
