It may be a little onerous to read but in short, it appears that all you may have to submit is a Revised Site Plan (essentially an amendment). If upon their review your plans for a patio do not substantially change the use of the area and are seen as an "accessory," (which I would think patios are), you should be OK to proceed without much fuss. Please contact Molly Hitchcock in the Planning and Development Services Department for information on how to proceed with submitting a revised site plan. Her information is below. I am one of the owners of Fast Eddie's Billiards located on University Drive. When the smoking ban was enacted, we took a very serious hit in our sales. We still to this day have not recovered. We have decided to finally build a patio, but are now being told by the City that we will have to resubmit a new set of plans and go through the entire planning process. This is to include at least two hearings, and a conditional use review that could take up to three months. So far, I have found a service that will do this for$4250. And then I have to pay for the patio itself. It is hard to understand how a City can make a rule (smoking ban) and then turn around and make it difficult and expensive to for a business owner to abide by this rule. I simply want to put an iron fence and some furniture outside my establishment to allow my patrons an area where they can smoke and drink.
