HomeMy WebLinkAboutordinance t • ORDINANCE NO. 2904 AN ORDINANCE AMENDING CHAPTER 12, "UNIFIED DEVELOPMENT ORDINANCE," SECTION 4.2, "OFFICIAL ZONING MAP," OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY CHANGING THE ZONING DISTRICT BOUNDARIES AFFECTING CERTAIN PROPERTIES AS DESCRIBED BELOW; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That Chapter 12, "Unified Development Ordinance," Section 4.2, "Official Zoning Map," of the Code of Ordinances of the City of College Station, Texas, be amended as set out in Exhibit "A", attached hereto and made a part of this ordinance for all purposes. PART 2: That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than Two Thousand Dollars ($2,000.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective ten (10) days after its date of passage by the City Council, as provided by Section 34 of the Charter of the City of College Station. FIRST I 'D LIKE TO EXPRESS THANKS TO TREY FLETCHER OF PLANNING AND DEVELOPMENT SERVICES FOR KEEPING OUR COMMITTEE APPRISED AS THIS REZONING REQUEST PROGRESSED. THE LOT BEING ADDRESSED THIS EVENING, 3970 HARVEY ROAD, IS ALSO LOT 31 , BLOCK 1 OF OUR COMMUNITY. THAT PORTION OF HARVEY HILLSIDES BORDERING HARVEY ROAD HAS THE UNIQUE DISTINCTION BEING BOTH IN THE HARVEY HILLSIDES COMMUNITY (WHICH IS IN THE COUNTY) , AND WITHIN THE CITY LIMITS OF COLLEGE STATION. WHILE THE ZONING IN THIS AREA IS SOMEWHAT OF A POLYGLOT, INCLUDING A-O, C-3, PDD-B, PDD-R, AND A-P, THE END RESULTS, WE BELIEVE, HAVE BEEN MOST SATISFACTORY WITH TOWNHOUSES, AN INSURANCE OFFICE, CHURCHES, TWO RESTAURANTS, A SELF-STORAGE FACILITY AND A LANDSCAPE COMPANY, ALL BLENDING IN WITH THE COMMUNITY. THIS IS THE RESULT OF CLOSE ATTENTION TO THE TYPES OF BUSINESSES APPROVED FOR CONSTRUCTION WITHIN THE ZONING PARAMETERS. WE ARE SUPPORTIVE OF INTELLIGENT PROGRESS, BUT IT MUST BE PROGRESS WITH COMPASSION--COMPASSION FOR THE CITIZENS WHO ALREADY LIVE WITHIN OUR COMMUNITY. PAGE 2 OF 2 IN CONSIDERING THE REZONING REQUEST THE ARCHITECTURAL CONTROL COMMITTEE REVIEWED THE CURRENT DEVELOPMENT IN THE AREA, LOOKING CLOSELY AT THE ACTIVITIES PLANNED ALONG THE NORTH SIDE OF HARVEY ROAD. SPECIFICALLY, WE LOOKED AT THE CRESCENT POINTE DEVELOPMENT WITH ITS C-1 ZONING AND THE AREA DIRECTLY ACROSS FROM LOT 31 WHICH IS, AS I RECALL, ZONED PDD-R. ALSO THE COMMITTEE WAS CONTACTED BY ONE PROPERTY OWNER WHOSE LAND ADJOINS LOT 31 . HE IS FAVORABLY DISPOSED TO THE REZONING. THE COMMITTEE VOTED TO RECOMMEND THAT YOU APPROVE THE REZONING REQUEST FROM AGRICULTURAL-OPEN, A-O, TO ADMINISTRATIVE-PROFESSIONAL, A-P. WE WILL, OF COURSE, BE FOLLOWING CLOSELY WHAT IS PLANNED FOR THIS PROPERTY, WITH PARTICULAR EMPHASIS ON BUFFERING, LANDSCAPING, HIGHWAY ACCESS, AND ANY POTENTIAL ADVERSE IMPACT ON ADJOINING TRACTS. THE INITIAL INFORMATION WE'VE BEEN PROVIDED REGARDING THE DEVELOPMENT OF THIS TRACT APPEARSVERY FAVORABLE.
