McGruder Rezoning (06-84) SAM: This item is a rezoning request from R-1 Single Family Residential to C-1 General Commercial for the same property that you just considered for Comprehensive Plan Amendment. The applicant has stated in his application that this is for the development of a Tire Max, but all C-1 uses should be considered with the rezoning. LUP AERIAL: The Land Use Plan currently shows the property as Single-Family Residential High Density. You just heard a request to amend the Comprehensive Plan to designate this property as Regional Retail, and recommended that the Council that request. <<While C-1 General Commercial zoning is generally acceptable in areas designated as Regional Retail, the property has limited access and is within an established single-family neighborhood.>> Staff recommends denial of the �^� rezoning. As discussed in the previous item, the property has approximately 80 feet of `� frontage on Texas Avenue and approximately 185 feet of frontage on Sterling Street, a residential street. Again, staff has a concern about future commercial "\ I� development on this property with its limited frontage on Texas Avenue. While , \ * A City policy is not to locate commercial driveways on residential streets, the \® minimal lot width on Texas Avenue will not permit driveway access to Texas Avenue and the commercial access would have to come from the residential street. Neighborhood Protection Standards contained in the Unified Development Ordinance provide buffer and height limitations to properties located adjacent to the subject property, but do not provide protection for the single-family homes located across Sterling Street that face the subject property. I appreciate being able to co-process these items as it will save our clients time in their site selection process. I understand from our pre-application conference yesterday that the city has concerns about this land use in close proximity to a residential use, and that staff will be investigating the entire area adjacent and east of Texas Avenue as part of this request. We need to explore several issues: 1) Comprehensive Plan Amendment SF High Density to Regional Retail 2) Rezoning R-1 to C-2 In addition, since the parcel in question is apparently an old metes and bounds tract, we need to do a preliminary plat and a final plat. Can we combine these items or parallel process them? Will we need to dedicate additional right-of-way on Sterling?
