Preliminary Plat Application
originally submitted 04/14/06 - Revised 05/09/06 to add Variance Request
VARIANCE REQUEST:
1) We interpret"in general"to mean most of the time. This lot configuration complies with
that requirement.
2) The developer does not believe this lot configuration to be detrimental to the sale-
ability of the lots. He alone will suffer the consequences.
3) The location of the sanitary sewer line is a constraint that will not allow two lots to be
created which face Justin Drive. So,that would leave 1 large estate lot which is out of
character from the remainder of the subdivision.
4) The health, safety and welfare of the lot owners or public is not jeopardized with the
creation of lots which are at right angles to each other.

following page is a list of staff review comments detailing items that need to be

Monday October 30th by 10:00 a.m. to be placed on the next available Planning and
Zoning Commission meeting scheduled for November 16th at 7:00 p.m. in the City Hall
Council Chambers, 1101 Texas Avenue.
Two (2)24" x 36" copies of the revised preliminary plat;
Fifteen (15) 11" x 17" copies of the revised preliminary plat;
One(1) Mylar original of the revised preliminary plat; and,
One (1) copy of the digital file of the preliminary plat on diskette or e-mail to
sgriffin@cstx.gov and awelsh@cstx.gov; and
Once your item has been scheduled for the P&Z meeting, the agenda and staff report
can be accessed at the following web site on Monday the week of the P&Z meeting.

Subject: North Forest Estates
Gary Gore who lives at 8406 Spring Creek has some questions about the North Forest Estates plat. He saw a backhoe
and had some questions about tree preservation. I gave him Justin Whitworth's contact information because they are
offering to buy a lot to save some trees.
Can someone call him about where they are in the process, in particular the DP? I told him the preliminary was
scheduled for the May 18 consent(so no public hearing) and that the final would follow, but neither would warrant
notification. Anyway, thanks!

I have a attached a GIS pic of a piece of property located off North Forest Dr. In the picture I have circled the
particular sewer line I am interested in. I do not show nor does the engineer show that this sewer line has an
easement. I am assuming it is a prescriptive easement. Is it possible for you to verify this?
Property Owner: Swetish, Stephen and Elizabeth
Legal Description: A004601 M. Reactor ICL Tract 67, Acres 9.761

Jan I have attached the surrounding plats which show the easement on either side of this line. Actually in the
Emerald Forest plat it show the easement we are talking about as a 15' PUE or Sewer Ease, Vol 322 and Pg
465. You may take a look at the plats I have sent anyways to verify that I have not missed something.
