This item is a PDD rezoning for 3101 Texas Avenue to add vehicle rental as an accessory
use to the existing mini-storage development located there.
The subject tract backs up to the Mile Drive neighborhood.
A rezoning was brought forward for this request in 2004 which was never acted on by
City Council after the applicant withdrew the request.
The new owner brought forward a request which was heard by the Planning and Zoning
Commission on January 3rd where the neighborhood expressed concerns about the noise
and aesthetic issues of allowing vehicle rental as a use.
At that time, the Commission requested that the owner meet with the neighbors to resolve
these issues. At that meeting, they were unable to reach an agreement regarding the use.

The item came before the P&Z again on February 12th and the neighbors were still very
opposed to the rezoning. However, the P&�L recommended approval of the rezoning with
the condition that the area allowed for overflow parking be halved, that screening be
providearound the proposed parking area to be a size to accommodate 8 vehicles. In
addition, they encouraged the owner to continue the operational changes his

Rezoning for 3101 Texas Avenue

Agenda Caption: Public hearing, presentation, possible action, and discussion on an
ordinance rezoning5.7 acres located at 3101 Texas Avenue generally located northeast of
the intersection of Deacon Drive and Texas Avenue from PDD, Planned Development to
PDD, Planned Development in order to add Vehicle Rental as an accessory use.
Recommendation(s): The Planning and Zoning Commission voted 5-2 to recommend
approval with conditions at the February 12th meeting. Staff recommended approval.
Summary: This item is for the rezoning of the property located at 3101 Texas Avenue to
add Vehicle Rental as a use for the existing PDD development (All-Size Storage). A rezoning
for this use came before the Planning and Zoning Commission November, 2004 which was
recommended for denial by the Commission and was pulled before the item was heard by
City Council. The applicant went before the Planning and Zoning Commission on January 3,
2008 and the item was tabled in order for the owner to meet with more of the residents
about the proposal. A meeting was held on January 10, 2008, and the residents in
attendance representing 14 of the 16 properties do not support the rezoning.
In 1988, this property was rezoned from A-P, Administrative Professional to C-3, Planned
Commercial after an agreement was reached between the residents of Mile Drive and the
owners of the subject property. The agreement included a greenbelt reserve and an
adjacent access easement to serve as a 70-foot setback from the residential property for
future structures on this site, and the use of the property under C-3, Planned Commercial, a
less intense commercial district. Under the current regulations, mini-storage no longer was
a permitted use in C-3, which was renamed to Light Commercial.
A PDD, Planned Development District zoning was requested to allow the construction of the
mini-storage development that is now in this location. The PDD restored this original
agreement between the property and the adjacent neighborhood with the exception of
vehicle rental.
The P&Z recommended that the parking area for vehicles be limited to parking for 8 trucks
(42 x 36 sf), that the area for overflow parking be halved, solid fencing be vided in all of
the gaps between the buildings and extending to the property line to the)and that
screening be provided around the truck parking area with 4-foot plantings to create a solid
hedgerow.

Item Summary: This item was originally heard by the Planning and Zoning Commission on January 3 '.
The Commission tabled the item until a full neighborhood meeting could be held to work out issues
between the owner and the neighborhood.
A meeting was held on January 10th and the neighborhood is opposed to the request.
Comprehensive Plan Considerations: The Comprehensive Land Use Plan designates this property as
Retail Neighborhood. The property has frontage on Texas Avenue and the East Bypass, a major arterial
and freeway respectively on the City's Thoroughfare Plan.
Item Background: Commercial zoning on this property has been contentious in the past. Prior to the
recent PDD rezoning, Staff, Mile Drive residents, and the property owners met and agreed on uses to be
included in the PDD. The applicant has again met with the neighborhood about the addition of vehicle
rental to the site.

This item is a rezoning request for an existing Planned Development
District in order to add vehicle rental as an accessory use for the
property located at 3101 Texas Avenue South.
Background:
In 1988 the property was rezoned to C-3, Planned Commercial with
the condition of a 70 foot greenbelt and a private agreement between
the Mile Drive residents and the property owner which defined the
agreed upon uses.
The property remained undeveloped until 2004. In 2004, after the
adoption of the Unified Development Ordinance, C-3, Light
Commercial no longer allowed mini-storage warehousing which the
owner wanted to develop on site and was one of the agreed upon
uses in 1988.
A PDD was adopted on the property in 2004, however vehicle rental
was not included at that time, gnat ate
t. In order to correct this, the owner brought forward
another rezoning to add vehicle rental. Staff recommended approval,
however the Planning and Zoning Commission at the time felt that it
was too intense a use for the zoning district and recommended for
denial. The request was withdrawn and never acted on by the City
Council.
Since that time, the property has developed as mini-storage, and the
current owner is again requesting to provide vehicle rental as an
accessory use to the mini-storage warehouse.
The applicant has provided a concept plan showing the location the
trucks would be located after drop off (49 x 42). It is located on the
south side of the property furthest from the Mile Drive residences.
The applicant has also held a meeting with the neighborhood, with 2
neighbors in attendance. Staff has not received any responses from
the neighborhood in regard to the legal notifications.

Staff is recommending approval. The Planning and Zoning
Commission does have the authority to review Concept Plans in
conjunction with a PDD rezoning and may recommend changes,
conditions or additions to offset any negative impacts.
An accessory use is one that is subordinate and serves a primary use and contributes to the
comfort, convenience, or necessity of occupants of the primary use being served.The use of
vehicle rentals as an accessory to a mini-warehouse use is an example of an accessory use and
serves as a convenience to those served by the mini-storage. Once the primary use is removed,
an accessory use must be removed with it.

accessory use. Accessory uses those that are subordinate to the primary use in area, extent,
and/or purpose. The truck rental accessory use was denied as it was characterized as a use too
intense for the zoning district.
The owner is again seeking to provide truck rental on their property. As it is restoring that original
agreement, and the owner is requesting to add the vehicle rental as an accessory use, Staff is in
support of the rezoning. Due to a recent change in the UDO, the Commission has the ability to
have review Concept Plans which includes the placement of the vehicle rental on site to minimize
their impact.
