On September 24, 2007, it came to our attention that rental trucks were being stored and / or rented at 3101 Texas Avenue South, Metro-Mini Storage. I informed the manager on duty, John, that this was not a permitted use. He assured me that the trucks would be removed as soon as possible. As of today, October 18, 2007, the trucks are still on site and must be immediately removed. Upon your request, I am sending the applicable rezoning ordinance for the property as well as minutes from a later Planning & Zoning Commission meeting where the specific use was requested and denied. As you are aware, the subject property is zoned PDD (Planned Development District) and truck rentals are not listed under the uses allowed for the PDD zoning. Therefore, please have all rental trucks removed from the property within sixty (60) days of receipt of this letter. Thanks in advance for your assistance in resolving this matter. I agree we don't really need to waste ya'll's time or mine on this one. We did meet with the adjacent lot owners and they are cool with it so there really isn't anything to talk about. The previous P&Z meeting where this was denied was before phase two was completed and the only commissioner still on the P&Z is Bill Davis. I thought I'd give him a call sometime and explain why this is back and what has changed. So just lemme know and I'll call the owner today so he doesn't have to drive from Houston for a PAC. I noticed today that the checklist for the concept plan got stuck to another paper in my briefcase. It's probably not that big a deal because the storage buildings are there and the plan just shows where the small parking area will be placed inside the fence and where overflow will occur on an already paved area. So, if that technicality of omitting the checklist is OK, I'll just not worry about it. If you need me to drop it by I will. Thanks, LB. Jane R. I am scheduled for the PAC on Wednesday, but considering your familiarity with the site and our process, I was wondering if the PAC would be necessary. I haven't completed reviewing all the old case files, but I can give you a call this week and let you know if I see file://C:\Documents and Settings\lboyer.CSTX\Local Settings\Temp\XPGrpWise\474C01... 11/27/2007 Page 2 of 2 any issues that would preclude staff support rather than a PAC.
