SUBJECT: PLAZAS AT ROCK PRAIRIE (PP) -Preliminary Plat
Staff reviewed the above-mentioned preliminary plat as requested. The following page is a list
of staff review comments detailing items that need to be addressed. If all comments have been
addressed and the following information submitted by Monday, May 1, 10:00 a.m., your
project will be placed on the next available Planning and Zoning Commission meeting
scheduled for May 18, 7:00 p.m. in the City Hall Council Chambers, 1101 Texas Avenue.
Two (2) 24"x 36"copies of the revised preliminary plat;
Upon receipt of the required documents for the Planning & Zoning meeting, your project will
be considered formally filed with the City of College Station. Please note that if all comments
have not been addressed, your project will be pulled from the scheduled Planning & Zoning
Commission agenda. Your project may be placed on a future agenda once all the revisions have
been made and the appropriate fees paid. Onceyour item has been scheduled for the P&Z
meeting, the agenda and staff report can be accessed at the following web site on Monday the
week of the P&Z meeting.

Re: Plazas at Rock Prairie - Right-of-Way Dedication
Dear Mr. Ogilvie:
We received your letter dated June 13, 2006 regarding the right-of-way
dedication along Rock Prairie Road, adjacent to the proposed Plazas at Rock
Prairie development. Based on ipectiorr§212.904 of the Local Government Code,
the City can require that a developer bear a portion of the costs of municipal
infrastructure improvements as long as those costs are roughly proportionate to
the proposed development. I will be working with our Legal Department on a
more specific response to your letter. In the mean time, if you have any questions

In December 2005, we purchased 2 adjacent parcels of land on the northeast corner of
Rock Prairie Rd. and State Highway 6 for the sole purpose of developing a shopping
center on the site. As we proceeded with our pre-development plans, we were able to
successfully have a portion of one of the tracts re-zoned to Commercial in January 2006.
Immediately thereafter, we initiated the process of having the two tracts re-platted due to
the fact that we had purchased them from 2 different owners.
We have been informed by the city that our re-plat will not be approved and thus we will
not be granted a building permit, due to the City of College Station's plans to classify
Rock Prairie Road as a major arterial. We have been told that as a condition to plat
approval and ultimately the issuance of a building permit, we will be required to dedicate
15 feet of additional right away along Rock Prairie Road to accommodate the future
expansion.
Although we would prefer not to dedicate the 15 feet of Right of Way altogether, we do
not feel that the city has the right to demand the dedication without just compensation.
The attempt to do so violates both Article I, Section 17 of the Texas Constitution and The
Fifth Amendment to the U.S. Constitution,both of which require payment for taking of
private property for public use. Furthermore, the city's act to take the land is contrary to

the holdings of City of Houston vs. Kolb, The State of Texas vs. Biggar, and finally the
ruling of the Supreme Court of the United States in Dolan vs. Tigard.
In conclusion, we would like to cooperate with the City's ultimate thoroughfare plans,
but we do not intend to do so without just compensation for the taking of our private
property.

Dear Property Owner,
The City of College Station Planning&Development Services Department is working on
an update to the City's Thoroughfare Plan in the State Highway 6/ Rock Prairie Road /
Greens Prairie Road triangle. The proposed changes include classifying Rock Prairie
Road as a major arterial, aligning the proposed Barron Road east of SH 6 with the
existing Barron Road west of SH 6, and adding some minor collectors in the planned
residential areas.
As a property owner, you are invited to an Open House to meet with City Staff about
the changes, and provide input on the amendment. This meeting will be held on
Tuesday, March 28, 2006 from 5:00 to 7:00 p.m. at the City of College Station
Conference Center(Room 102),located at 1300 George Bush Drive in College Station.
