Item Summary: This item is a follow up comprehensive plan
amendment for the Spring Creek area that was approved by the City
Council in February for Single Family Residential, Medium Density,
Office, and Retail Regional on this tract. The request is for a 1 .4 acre
portion of the floodplain that was not originally included in the initial
(Act1nctnck)--afferldfent that was approved by Council in February. This
amendment would not increase the area that was originally thought to
be Retail Regional. The original application included this area of
floodplain, however staff and the applicant were unaware that the
zoning and land use boundaries were different and the ordinance that
was approved was only for the residential attached area.
In 1997, a Master Plan for the entire Crowley tract was approved
which included the R-4/Apartment designation for this area. This plan
and its subsequent amendments also included a large area dedicated
as a conservation easement to the Corp of Engineers. This area is
within the 100 year floodplain, but was not included in the
conservation easement.
The staff reports and minutes from those meetings indicate that the
staff considered this Master Plan to effectively amend the
Comprehensive Plan in place at the time. In 2001 , rezonings were
approved in compliance with the Master Plan and followed the
boundaries of this Master Plan. However, the changes to the
Comprehensive Plan were not made to the Plan maps until 2003.
During that 2003 amendment the land use boundaries did not follow
the conservation easement boundaries on this tract, which staff, City
Council, and the P&Z had previously approved, creating a 1 .4 acre
tract which had a R-4 zoning no longer in compliance with the
Comprehensive Plan designation of Floodplains and streams.
The subject property is currently zoned R-4 and may currently be
developed for apartments. However, no matter what zoning and land
use that is in place, all development must comply with the City's
drainage policies regarding the 100-year floodplain.

This amendment is to amend the plan on this tract from Floodplain
and Streams to Retail Regional. Staff recommends approval of this
request based this property's history and prior intent for development
supported by City Staff, the Planning and Zoning Commission and
the City Council.
