The following page is a list of staff review comments detailing items that need to be addressed. If all comments have been addressed and the following information submitted by Monday January 29th at 10:00 a.m., your project will be placed on the next available Planning and Zoning Commission meeting scheduled for February 15th at 7:00 p.m. in the City Hall Council Chambers, 1101 Texas Avenue. Each comment received from the Planning Department shall be addressed by the number and order listed upon the Staff Review Comment Sheet. The responses are as follows: 1. Attached as requested is a 1" = 10' scale drawing depicting the lot lines proposed for the Dominion on Dominik project. 2. The dumpster enclosure shall be 12'X12' for this project. Earlier discussions with Wally in sanitation indicated that one (1) dumpster will be sufficient for this project. 3. The curb and pavement details are provided on Sheet C5.2 in the previously submitted site construction plans. 4. Gessner Engineering and the Owner understands that the City of College station staff will not support a plat that creates lots that can not meet the required building setbacks. 5. The City Secretary's signature from the Planning and Zoning Commission certificate has been removed as requested. 6. The Lots 2-J through 2-F facing George Bush will have the required setbacks. Regardless, I'm working on getting a new mylar generated, and I am under the impression that we can have it revised with the additional corrections that we discussed, printed, and signed by the surveyor by close of business tomorrow, so that friday, a representative of Atticus can hand deliver the new mylar to the city where they will sign the document and have it notarized by one of the notaries at city hall that you mentioned. I reviewed the doc which you sent me against the latest version of the plat that i have, and they match verbatim. as we discussed, the following changes will be made: 1) since, "12' Shared Drive See Note 5" is already denoted near Lot 2-J, the notation located on Lot 2-D will read: "20' Public Utility and Drainage Easement" 2) as far as the notation located on dominik goes, I'd like to simply have it removed as shared drive is already denoted, and the drainage easement is already denoted. if that is unnacceptable, I suggest"Private Drainage Easement" (private access omitted as there are no plans for access at that location. if you can let me know if any of the changes are unnacceptable, i would really appreciate it. if it's easier for me to send you an electronic copy with the proposed changes, i can do that as well. Josh and I just talk to Alton Rogers on the phone to let him know that the construction documents/development permit for the utility work is ready to be picked up. Josh has stamped the plans for approval of public utility work only. Some of the detail provided with theses construction documents is not related to the construction of the public utilities and cannot be approved with these plans. However, in further investigation of this detail provided it appears that the buildings are not meeting the 20' building setback from the rear access easement line. Some of the options available to you to alleviate this problem are to shrink the existing 20' access easement to a 12' on the Mylar before it is filed, also balconies can encroach the 15' front building setback by 6'. If the required 20' rear setback from the access easement is still encroached then a Variance will need to be applied for from the Zoning Board of Adjustments. The site plan detail provided with the public utility construction documents is more appropriately submitted and reviewed with the building plans/building permit. However, we understand the implication of this rear setback requirement and wanted to make you aware before the public utility work began. As previously stated we have let Alton know that construction documents for public utilities only are ready for pick up and made him aware of the above mentioned issues. After you and I talked yesterday, I went to the City of College Station to talk with Trey Fletcher with regards to this project. I asked him about all the scenarios available to possibly permit this site with the density of units requested (eleven units). The site is currently zoned as R-3 (Townhouses). There are three (3) potential problems with the existing layout based upon Section 5.2 of the College Station Unified Development Ordinance(UDO). The table in Section 5.2 of the UDO gives the residential dimensional standards for a Townhouse development. The three (3) potential problems are: 1) The lots must have a minimum of 2,000 square feet(sf) of area. Currently our lots range from 1332.25 sf to 1681.91 sf. There is approximately 6,400 sf of common area for fire and residential access and for drainage requirements. 2) The rear setback for each lot must be twenty (20) feet. Currently we have approximately ten (10)to thirteen (13) feet of rear setback. 3) The maximum dwelling units per acre is fourteen (14). Therefore the maximum number of units for this lot is seven (7). We may be able to meet the 2,000 sf lot requirement with some creative engineering. However, the rear setback and the maximum number of units per acre could be fatal. I asked Trey about possibly rezoning this site as R-4. This would eliminate the minimum lot size requirement, the rear setback and the maximum number of dwelling units per acre can be increased to twenty (20). The amount of area at this site would allow eleven (11) units for R-4 use. Trey said he will research this site to see if any R-4 requests have been made for this site in the past. The one problem with R-4 zoning is that the parking requirements increase. We will likely require three (3) parking spaces per unit. Therefore a total of thirty-three (33) parking spaces will be required. Currently we have twenty-four. The UDO does have a caveat that may be used. This caveat is Section 5.1.G, Multi-family (R-4). In this Section of the UDO says that Townhouse dwelling units shall conform to R-3, Townhouse standards. If the City will allow us to zone the lot as R-4, we will not need lots nor have a rear setback problem. The parking requirement for a townhouse is two (2) per unit. I will say that Trey did not know if an R-4 zoning is possible for this site due to past opposition from the neighbors. I suggested to Mark that he and I both talk to Trey at the same time so there is no confusion as to what the City of College Station staff report.
