I have also attached a copy of Ordinance No. 852 approved November 27, 1972, and filed of record of Vol. 310, Pg. 721 of the Deed Records of Brazos County, Texas. It appears it was the intent of the Ordinance to vacate and abandon the entire length of the above referenced easement, retaining only the 10' easement lying along the side of Lot 18. Unfortunately, the common line of Lots 4 and 15 was not mentioned in the Ordinance, leaving a small portion of the easement retained, but not attached to any other easement or public right-of- way, as reflected on the Survey Plat and the"original" side of the Replat submitted for this case. Upon careful research, it does not appear that any public utility ever existed within the easement area in question. Therefore, we are requesting that this portion of the easement be vacated and abandoned by way of the Replat rather than an"Easement Abandonment" procedure.
