Discussion: • Recommend not to amend annexation plan this year to add any areas other than those exempt under statute. (if we amend plan we have to notify affected properties). Then annex in 3 years. • Consensus was not to look at the Brushy Creek CCN area for this next year. (650 total customers, 34 in our city limits) • Look at Entergy service area / Speedway / across SH 6 from Speedway / along 158 / Jett area and all other tracts in that spot. • Dale will send me the addresses in Harvey Hillsides that we currently serve. He will send the Entergy service area and the revised CIP schedule for last year's annexation. • CSU will pay for survey and notices costs for the Entergy area. • Have another mtg. when we have revised maps. Note: • 3 or fewer resident petition is done in 30 days and requires no service plan • exemptions of fewer than 100 or 50% petition doesn't have to be in annexation plan but dies require full process and service plan August 15, 2003 Staff: Jon Mies, Frank Sim., Pete Cater, Lee Battle, Mike Patterson, Trey Fletcher Discussion: Met to distribute annexation map and maps of individual areas. Included acreages and street miles. Asked for cost impacts to be returned to me by the end of August. (revised for Aug. 25th) properties. Response times were minimally affected. Dept. is at a threshold now where the additional developed properties and street miles in the first part (particularly SH30 and Speedway) will adversely affect response times, available pro-active time, and staffing, all which will diminish ability to provide adequate service. Another beat will have to be created at an initial cost of $500,000 with on-going costs of $350,000. Will require 5 additional communication operators at a cost of $182,540 annually. • Second part will require an additional officer at $66,210 initially and $57,600 annually. Sanitation • Can absorb exempt areas w/o additional personnel but will need additional back up equipment. $200,000 one time costs / $60,000 recurring O&M costs • Adding other 3 developed areas will require 3 more personnel in addition to the above equipment plus some additional equipment. $375,000 one time and $235,000 recurring O&M. Road Maintenance and Mowing • For exempt areas total O&M for street maintenance and ROW mowing is $58,678. Projected capital costs are $7,380,900. • For Harvey, Nantucket and Woodlake areas total OEtM is 126,984 with projected capital costs of $1,093,050. Water &t Wastewater • Exempt areas - 3.3 million for wastewater and minimal for water • Developed areas - ??? Annexation Plan Requirement Subchapter C of Chapter 43 Local Government Code requires that cities prepare an annexation plan. Property can be annexed on the third anniversary of inclusion in the plan. The plan serves to provide a three-year notice to property owners of a city's intent to annex. The statute provides several exceptions to the requirement for inclusion in an annexation plan. Two of these exceptions are applicable in College Station. One exception exempts annexations that include fewer than 100 separate tracts of land on which one or more residential dwellings are located. Another exception exempts properties that petition for annexation. The City's statutorily mandated Annexation Plan currently provides that the City has no plans for annexation outside those areas that are exempt from the annexation plan requirements of the Local Government Code. This plan is reviewed and updated from time to time. Current Annexation Plan - City of College Station Pursuant to Section 43.052 of the Local Government Code, The City of College Station will only annex areas that are identified in this municipal annexation plan or exempt from the provisions of Section 43.052. Areas specifically identified herein may be annexed on the third anniversary of the adoption date of this plan or on the third anniversary an amendment to include such area in this plan. Specific areas planned for adoption, if any are: • No areas are identified for annexation Other areas that may be considered for annexation by the City of College Station include only areas which are exempt from Section 43.052 including: • Areas which contain fewer than 100 separate tracts of land on which one or more residential dwellings are located on each tract. • Areas annexed by petition of more than 50 percent of the real property owners in the area proposed for annexation or by vote or petition of the qualified voters or real property owners. • An area which is or was the subject of an industrial district contract under Section 42.044 of the Local Government Code • An area which is or was the subject of a strategic partnership agreement under Section 43.0751. • An area annexed under Section 43.026, 43.029 or 43.031 of the Local Government Code. • An area the City Council of the City of College Station determines that the annexation of the area is necessary to protect the area proposed for annexation or the City of College Station from: o Imminent destruction of property or injury to persons. o A condition or use that constitutes a public or private nuisance as defined by background principles of nuisance and property law of the State of Texas. Following adoption of this municipal annexation plan by the College Station City Council, and so long as the City of College Station maintains an Internet website, the City of College Station will post and maintain on its Internet website: • This municipal annexation plan. • Any amendments to include an area in this municipal annexation plan until the date the area is annexed. • Any amendments to remove an area from this municipal annexation plan until the date the area is again eligible for inclusion in the plan.
