According to the Unified Development Ordinance Section 3.15, the Administrator has the authority to authorize adjustment of up to 10 percent from any numerical zoning standard set forth in Articles 5, 6, or 7 of the Unified Development Ordinance. To approve the application for an administrative adjustment, the Administrator shall make an affirmative finding that specific criteria, as outlined in Section 3.15.E of the Unified Development Ordinance, have been met. The Administrator has found that: Granting the adjustment will ensure the same general level of land use compatibility as the otherwise applicable standards because the encroachment in minimal; Granting the adjustment will not materially or adversely affect adjacent land uses or the physical character of uses in the immediate vicinity of the proposed development because of the radius of the cul-de-sac makes the encroachment difficult to visually discern; and i - 0 • Page 2 March 14, 2006 Granting the adjustment will be generally consistent with the purposes and intent of this UDO because the encroachment is minimal and would be difficult to discern. I say we issue the AA - I think this is a good example of the type of issue that Section 3.15 was written to address. There is no hardship or special condition that I see. The home was built in 2005. Terry reviewed the plans, which show NO encroachment. The inspectors inspected the home during construction and the forms were not encroaching into the setback(according to the string lines pulled by the builder). So, basically, the builder did two things: 1. He did not build the house in the location shown on the approved on the site plan 2. He did not pull the strings in the correct location. At this point, do we issue the AA because it would correct an existing situation, or do we forward it on to ZBA because staff cannot not find a special condition or hardship that is not self created?
