RE: Popeye's Chicken Restaurant on Graham road

Please forward this letter to the Design Review Board for their use. We have tried to address
your concerns as they relate to the color (Peach Crisp Maize #159) by Benjamin Moore. This
letter is intended to address the three items that are outlined in section 7.9.K.2 Variances -
Design Review Board of the UDO:
a. The applicant is a franchised and/or chain restaurant to be developed as a single
detached building(not integrated into a multi-tenant building);and
b. The proposed colors are part of its corporate branding; and
c. The applicant provides all of the alternative color schemes the chain or franchise has
used.
Answer to a. Yes the applicant is a franchised restaurant and a single detached building.
Answer to b. Yes the proposed color that is under dispute is a part of the companies
corporate branding.
Answer to c. There are no alternative color options from the franchise for this color. We are
including the Popeye's web site i.e popeyesdevelopment.com and the password lagniappe for
your use to confirm what we are saying.
We hope that we have addressed all of your concerns and that we can resolve this matter
soon. The design for these restaurants are very attractive and have become a great asset for the
Popeye's franchise. We have included photos of one of the owners facilities in Houston for
your use.
