Joe,
I wanted to get this information to you as soon as possible, and calling your office you were out. I will be
headed out for lunch in a bit so am emailing instead. I was reviewing your revisions and there is still a problem
with the floodplain area. Looking at the rezoning and the comp plan amendment, the boundaries were not the
same. We processed the comp plan amendment only for the Residential Attached area which was indicated on
the application. All of the notifications for Council and P&Z hearings were only for Residential Attached, no
portion of the Floodplains and Streams were changed in this process.
A portion of the C-1 rezoning includes areas that are designated as Floodplains and Streams at the south end of
the property and we cannot take a rezoning forward with a positive recommendation for any area that is not in
compliance with the comprehensive plan. If this is to move forward to the April 6 meeting, we must have
revised maps (2 24 x 36s and 15 11x 17s) and metes and bounds by Friday which either exclude this portion
that lies in the 100 year flood plain, or rezones it to A-O in compliance with the Comp Plan. If you would like to
remove this portion from Floodplains and Streams, it will require a separate Comp Plan amendment. Staff would
only support this change if you can show that the subject area does not lie within the 100 year flood
plain.Taking this option separately will not hold up the remainder of the rezoning if you would like to exclude it
and comp plan/rezone it at a later time.

Remarks: Attached are 2 copies of the revised Rezoning Map. Our Response to Staff
Comments is included.
Planning Comment#1 —The proposed zoning boundary does not follow the
previous zoning boundary due to updated survey data around the COE
restricted area and the conservation zone and a change in the proposed right-
of-way for the intersection of Decatur Drive and Arrington Road.
Planning Comment#2 —The Crowley Tract has a COE permit which
identified the wetlands, Navasota Ladies Tresses habitat and waters of the
U.S. areas to protect. 70 acres of land was set aside for no development so
that the remainder of the property could be developed.
