Brett Cumpton REQUEST: Sign Variance LOCATION: 1842 Graham Rd. PURPOSE: To increase the height of the low profile sign. GENERAL INFORMATION Status of Applicant: Architect for the development, and representing the owner Property Owner: Salil Keswani Applicable Ordinance Section: Section 7.4, Signs PHYSICAL CHARACTERISTICS Zoning and Land Use • Subject Property: C-1 General Commercial • North: C-2 Commercial, Industrial developed as a vehicle service shop • West: C-1 General Commercial, currently vacant • East: C-1 General Commercial, developing as a bank • South: C-1 General Commercial, currently vacant Frontage: 125' on Graham Road, a major collector Access: Property will take access from Graham Road Topography & Vegetation: Relatively flat with some vegetation Flood Plain: No floodplain is located on the property VARIANCE INFORMATION Background: The applicant first met with staff in August 2005 to discuss the development of a free-standing Popeye's Chicken restaurant at the corner of O:\group\deve_ser\stfrpt\zngstfrpt\honda.doc Graham Rd. and the SH 6 frontage road. In addition to site plan requirements, he was made aware that the lot was a part of a building plot and would share signage with adjacent lots, as noted on the plat; however, the lot would be allowed a low-profile sign, limited to 4 feet in height and 60 square feet. The applicant was also made aware of the sign restriction as part of the building plot at the site plan review stage, when the applicant applied for a freestanding sign permit requesting a 12'-4" sign, which was denied. The variance request includes a 5' foot low-profile sign (see attached), thus the applicant is requesting a one foot variance. ANALYSIS Special Conditions: The applicant states: "The owner was not aware of the sign restriction for this site. Once he was made aware of the special development req'rmt he reduced the sign to just the top section (see attachment)." Hardships: The applicant states: "The Popeye's Corp. sign the owner has purchased is shown on the attached dwg. The arch on top of the sign is 12" taller than the 4' height allowed." Alternatives: The applicant offers no alternatives. Recommendation: Staff is recommending denial for this request.
