AGENDA ITEM NO. 5: Presentation, possible action, and discussion on
exterior siding materials for Outback Steakhouse located at 2102 Texas
Avenue South (CH 06-500023). (Amended)
Staff Planner Crissy Hartl presented the staff report stating that the applicant is
requesting to use an exterior siding that exceeds the façade limit for building
materials established by Section 7.9 D 2 of the Unified Development Ordinance.
Outback Steakhouse is proposing to enclose their outdoor patio and desires to
use the same hardi-plank siding material already in place for the restaurant at
their existing location. The Non-Residential Architectural Standards limit certain
materials, including hard board/hardi-plank, to 75% of the overall façade. The
applicant has exceeded the limit, as a great majority of the existing façade is
hardi-plank, thus they are requesting a variance from the Design Review Board.
The applicant is also proposing to add two canopies over the proposed windows
to satisfy additional Non-Residential Architectural Standard requirements.
The applicant is requesting an alternate material scheme that is consistent with
the following parameters:
1. The applicant is a franchised and/or chain restaurant to be developed as a
single detached building (not integrated into a multi-tenant building); and
2. The proposed materials are part of its corporate branding; and
3. The applicant provides all of the alternative materials schemes the chain
or franchise has used.
Following Ms. Hartl's staff report, there was some discussion concerning the
definition of a façade and how the definition was applied with respect to the
Unified Development Ordinance.
Mr. Wells motioned to approve the variance allowing the hardi-plank siding
material provided the siding on the north facade of the extension is limited
to 75%. Mr. Goodwin seconded the motion which passed unopposed (4-0).

Attached is the staff report I wrote for Outback; however, there is a catch - none of the information I wrote
about is in their letter requesting the variance. It is all what I have learned from the PAC and various other
conversations. May I suggest that someone call the owner and ask for a revised letter providing the
appropriate information?
In the PAC I told Mr. Lys that the letter would need to state his intent- basically, "I am requesting a
variance to use hardi-plank on the new portion/100% of the building because: 1) Outback is a franchised
and/or chain restaurant; 2) the materials are a part of its corporate branding; 3) here is information that
proves no other material scheme has been implemented." He has a copy of the ordinance and I pointed it
out, so I know he knows what to provide.
I think it's very important that we get a revised letter because it will be included with the packed and I think
the board is going to question how we got all of this information and why we didn't request more of it.
Lance, I discussed with you this morning that the board was very upset that we aren't asking for enough
information and they feel like we could be doing a better job in the application process.
Additionally, the board likes to drive by the subject properties so they have a better idea of what they'll be
voting on, and I know they will have questions as to why the work is already done. I say that to suggest
perhaps including something in the staff report that may explain it(even though we don't really understand
it). I'm just very afraid of the strong personalities on the board, what may come out of this discussion, and
how it will reflect on our staff. I hope I'm not overstepping my bounds, but it does concern me.
