Dear Mr. Kiran,
This letter is in response to our telephone conversation today, February 15,
2006, regarding Tract E, Ponderosa Place Subdivision (PZ Case 06-0500022).
In Chapter 9, Section 3, Definitions of the City of College Station Code of
Ordinances, defines "Lot" as "physically an undivided tract or parcel of land as
shown on a duly recorded plat." A "Subdivision" is "the division of a lot, tract, or
parcel of land into two (2) or more parts, lots, or sites, for the purpose, whether
immediate or future, of sale, division of ownership or building development. This
also includes the resubdivision of land or lots which are a part of a previously
recorded subdivision..."
Our ordinances require that a replat must be that of an existing subdivision
(Unified Development Ordinance, Article 11, Definitions: Replat). The lot that has
been presented for review does not meet this definition of a lot, as this
configuration is not the legal lot of record from the Ponderosa Place Section 2,
1982 subdivision. In order to meet this definition, the lot, "Tract E," must be
shown in its entirety, as shown on the original plat. Since a portion of this
property has been further subdivided without a legal plat, it is not recognized by
the City. The owner of the remainder of Tract E must be included in the replat.
Because a third lot encompassing only the easement will not meet minimum lot
dimensions, the remainder property should be incorporated into the adjoining
property. The adjoining property must be included in the replat.

Unless a replat is submitted that meets the City's definition of a lot and
subdivision is submitted to our offices by Friday, February 17, 2006, we will be
unable to schedule this item for our March 2, 2006 Planning and Zoning
Commission meeting. The deadline for the March 16, 2006 Planning and Zoning
Commission is February 20, 2006, however, if a plat is submitted by February 24,
2006, we would be happy to process the plat and prepare it for the March 16,
2006 meeting.

SUBJECT: PONDEROSA PLACE SECTION 2 (FP) - Final Plat
Staff reviewed the above-mentioned final plat as requested. The following page is a list
of staff review comments detailing items that need to be addressed. If all comments
have been addressed and the following information submitted by Monday, February 28; 13 t'1
2006, 10:00 a.m., your project will be placed on the next available Planning and Zoning
Commission meeting scheduled for March 2, 2006, 7:00 p.m. in the City Hall Council
Chambers, 1101 Texas Avenue.
Two (2) 24"x36" copies of the revised final plat;
Upon receipt of the required documents for the Planning & Zoning meeting, your project
will be considered formally filed with the City of College Station. Please note that if all
comments have not been addressed your project will not be scheduled for a Planning &
Zoning Commission meeting. Your project may be placed on a future agenda once all
