Travis Martinek Clarke&Wyndham, Inc. From: Jason Schubert [mailto:jschubert@cstx.gov] Sent: Monday, March 24, 2014 2:56 PM To: Travis Martinek Subject: Indian Lakes master plan Travis, I am following up on your question regarding the vesting status of the tracts that were acquired by Smiling Mallard Development, Ltd to add on to the Indian Lakes subdivision. Two Master Plan applications were submittec for these tracts in December 2007 (city files: 07-336 Partners in Habitat Preservation Tract 1 and 08-013 Partners in Habitat Preservations Tract 2) and I have attached a document that has an image that shows their general location. The master plan applications were approved by the Planning &Zoning Commission in February 2008. While the individual approvals for these master plan areas have expired, it is recognized that they were intended to be expansion/future development of the original Indian Lakes master plan area. As the Indian Lakes subdivision has continued to develop, these tracts have retained their vesting rights in relation to it. As such, the two Partners in Habitat Preservation are still vested to the date of their application back in December 2007. Development on these tracts will require the submission of a Preliminary Plan application for consideration. I will place this correspondence in above-mentioned files and recommend that you keep a copy for your records as well. Let me know if you have additional questions.
