Extension
Dear Lance:
On February 23, 2006 the City of College Station City Council approved a
Conditional Use Permit for the above reference project. We are currently
working on construction plans for this project and will have plans in for permitting
prior to February 23, 2007 but may not have obtained a construction permit prior
to this date. As we understand, we must be under construction prior to February
23, 2007 or request an extension to the Conditional Use Permit.
Because of the unknowns in the timing of receiving a permit we would like
to request an extension of the Conditional Use Permit.
Please let us know if you have any questions. As always thank you very
much for your help.

Staff reviewed the above-mentioned concept plan as requested. The following page is a
list of staff review comments detailing items that need to be addressed. If all comments
have been addressed and the following information submitted by Tuesday, January 17,
2006 at 10:00 a.m., your project will be placed on the next available Planning and
Zoning Commission meeting scheduled for February 2, 2006 at 7:00 p.m. in the City Hall
Council Chambers, 1101 Texas Avenue.
Two (2) 24"x36" copies of the revised concept plan;
Twelve (12) 11"x17" copies of the revised concept plan;
Upon receipt of the required documents for the Planning & Zoning meeting, your project
will be considered formally filed with the City of College Station. Please note that if all
comments have not been addressed your project will not be scheduled for a Planning &
Zoning Commission meeting. Your project may be placed on a future agenda once all
the revisions have been made and the appropriate fees paid. If you have any questions

STAFF REVIEW COMMENTS NO. 1
Project: WPC CONDOS (CUPU) — 06-00500001
PLANNING
1. Given the level of detail in the Concept Plan submitted in conjunction with the
Conditional Use Permit application, adherence to the provisions within Section 5.6.A
Wolf Pen Creek (WPC) may affect the site plan, which includes the following:
• Development Criteria;
• Dedication/Development of Drainage and Pedestrian Ways;
1. The Concept Plan appears to fulfill Subsection A of this section.
• Fill Materials;
• Lighting;
• Solid Waste;
• Relationship of Buildings to the Site;
1. This section should be integrated into the Concept Plan to the greatest
extent practicable.
• Relationship of Buildings to the Adjoining Area;
• Building Design;
• Miscellaneous Structures and Street Hardware;
• Landscaping (as reference below);
• Signs; and,
• Maintenance.
The proposed parking plan must be revised. Counting both garage spaces and drive
spaces is not acceptable. Required and surplus parking provided should be in
designated areas, not behind spaces counted within garages that may or may not be
accessible to the residents.
The process for this application will be as follows:
Planning & Zoning Commission — recommend action on CUP
City Council —final action on CUP
Design Review Board —action* on detail site plan
*The Planning & Zoning Commission and City Council will be asked of their
expectation for review of the detailed site plan as this is a Conditional Use
Permit. Therefore, "action" taken by the DRB may be regarded as "final or "as
"recommendation" resulting in the detailed site plan being reviewed by Planning
& Zoning Commission and City Council.
4. As a multi-family development, parkland dedication requirements must be addressed
by the Parks & Recreation Advisory Board prior to platting of the property and site
plan approval.
5. Provide a general note that all roof and ground-mounted mechanical equipment shall
be screened from view or isolated so as not to be visible from any public right-of-way
or residential district within 150' of the subject lot, measured from a point five feet
above grade. Such screening shall be coordinated with the building architecture and
scale to maintain a unified appearance.

LANDSCAPING/STREETSCAPING/BUFFER
1. With the concept plan level of detail, no landscape plan was provided for review.
However, should the Conditional Use Permit be granted for this use, landscaping
provisions must comply with Section 5.6.A.10 Landscaping. Requirements within the
referenced section are in addition to typical landscaping requirements found in Sec.
7.5 of the UDO.
2. Provide a general note that 100% coverage of groundcover, decorative paving,
decorative rock, or a perennial grass is required in parking lot islands, swales and
drainage areas, the parking lot setback, rights-of-way, and adjacent property
disturbed during construction.

MISCELLANEOUS
1. Irrigation system must be protected by a Pressure Vacuum Breaker, a Reduced
Pressure Principle Back Flow Device, or a Double-Check Back Flow Device, and
installed as per City Ordinance 2394.
2. All BackFlow devices must be installed and tested upon installation as per City
Ordinance 2394.
ENGINEERING —
1. Sanitary sewer will have to be relocated and easement abandoned prior to Site

2. Fill permit required for fill in floodplain.
3. Turnarounds for fire and sanitation required on northwest and northeast drive
aisles.
4. Depending on depth of relocated sewer line, proposed 15' PUE may need to be
20' wide.
5. Property needs to be platted.
6. With platting, easements are required on the along the rear of all platted lots.
This is not shown.

FIRE
1. This concept plan level of detail does not reflect many of the fire related requirement and
may result in changes reflected in the detailed site plan.
2. Is this a gated community? If so, additional requirements apply.
3. All of the drive aisles as depicted shall be shown as Fire Lanes.
4. Fire flow calculations required for detailed site plan and may impact concept plan.

Subject: CUP in WPC application question
Afternoon!
In response to your question of whether or not a conceptual site plan could be submitted as part of the CUP application
for multi-family in WPC, I've been over the ordinance and believe that it is dear in that a complete
application requires site plan that meets our minimum standards. As the Council may impose reasonable restrictions or
conditions to carry out the spirit of the UDO and mitigate adverse effects, they may make better decisions with complete
information before them.

Subject: Re: Wolf Pen Creek- potential development
Trey- I checked out their website and it looks like they only do multi-family housing (mainly student
housing). I did not see any reference to mixed use which concerns me. Should we go ahead and have a
meeting to discuss what the ordinance says about multi-family housing only(CUP) and what our position
might be on it. As I mentioned earlier, this information should be available from Jane or Natalie's files.

Thanks. sorry for responding so late, but I have been on vacation. Eons ago, I met with Jane and Natalie
and we internally agreed on which tracts we would support for a conditional use permit for 100% multi-
family. We might want to drag that information up in the event he pursues a PAC.

Inquiry calls come in daily, but because of our strategic interest in WPC I thought I would provide you with
this heads heads up as to a potentially significant development in the WPC District.
As Planner on Call yesterday I received a call from a Houston developer, Craig Dickerson (713-570-0350)
regarding the 12 ac tract across from FS#1, next to the Arbors Apartments. The firm is the Dinerstein
Companies http://www.dmcmqmt.com/home/and have developed here before on Holleman Drive West.
As you multi-family in WPC requires a conditional use permit unless the residential uses are located in
stories or floors above retail commercial uses. He did not seem put off by this and I encouraged him to
hold a PAC, or similar meeting with us discuss this potential project.
