Neither set of written metes and bounds close and further do not reflect the calls on the rezoning map. 2. Clearly indicate the boundary of the rezoning with a heavy or bold line. This bold line should clearly show the delineation between what is being rezoned to R-1 and what is staying as A- O. 3. The Master Plan shows the entire area of the parkland dedication and the oil well site to remain A-0. This is not what is depicted on the Rezoning Map. To: October 11, 2007 Regular Agenda Rezoning for 3370 Greens Prairie Road West Glenn Brown, City Manager From: Bob Cowell, AICP, Director of Planning & Development Services Agenda Caption: Public hearing, presentation, possible action, and discussion on a Rezoning for 3370 Greens Prairie Road West (Preserve at Stone Creek) consisting of approximately 188 acres from A-0, Agricultural Open to R-1, Single Family located at 3370 Greens Prairie Road West in the general area northeast of the intersection of Greens Prairie Road West and Sweetwater Drive between Castlegate Subdivision and Sweetwater Forest Subdivision. Recommendation(s): The Planning and Zoning Commission recommended denial through a failed motion for approval at their September 27th eeting. Staff recommends approval with the condition that no residential lots be platt within 130 feet of the compressor station. Summary: The applicant is requesting a rezo mg from A-0, Agricultural Open to R-1, Single Family Residential in order to pursue e development of a residential subdivision on the tract. The property is adjacent to Ca ti gate subdivision to the east (zoned PDD), Sweetwater Forest Subdivision to thew (zoned A-OR), and unplatted agricultural and vacant property to the north. In the southeast corner of the subject exists a petroleum compression station. Staff recommends the establishment of a safe distance residential lots be located from the potential hazard. Originally, when this item was considered at the Planning and Zoning Commission on September 20, 2007, staff recommended a radius of 600 feet. This distance is a standardized separation from an Oil and Gas Operation to a residence as in the Ch. 4 Business Regulations, Sec. 13 Oil and Gas Regulations, G. 1. b. This ordinance primarily guides the permitting of new oil and gas operation, and does not specifically apply to residences locating by an existing oil and gas operation. This ordinance was simply used by staff as guidance to quantify a separation distance to be considered with the rezoning. Additional research following this Planning and Zoning Commission meeting more specifically quantified the potential hazard. Staff does not believe an explosive hazard exists with this compression station as there is not a pressurized tank on site. However, based on this research a flammable hazard is estimated at a radius of 130 feet from the storage tank. Staff therefore recommends that no residential lots be platted within a 130 foot radius of the compressor station. Budget 8t Financial Summary: None Attachments: 1. Small Area Map (SAM) & Aerial 2. Rezoning Map 3. Item Background 4. Infrastructure and Facilities 5. Draft Planning and Zoning Commission Meeting Minutes, September 27, 2007 6. Ordinance N {») Dvtl.\vtil ~ l( STAFF REPORT The item before you is a rezoning request for approximately 18B acres at 3370 Greens Prairie Road West from A-0 to R-1. The Subject property is in South College Station just north of the city limit located between Castlegate and Sweetwater Forest subdivision. The area of the rezoning is identified as Medium and Rural Density on the Comprehensive Plan and Floodplain, however R-1, Single Family meets the intent of the comprehensive plan in this location. The rezoning area excludes approximately acres for a proposed park. This area includes the approximately 5 acr s of the floodplain. The property has access to Victoria Ori and Greens Prairie Road West. Development of the property will 'ncl e the construction of an extension of Victoria, and an unnamed north-s collector. There is also an existing compressor station on site in the southeast corner of the property along Greens Prairie Road. Originally, when this item was considered at the Planning and Zoning Commission on September 20, 2007, staff recommended a radius of 600 feet. Additional research following this Planning and Zoning Commission meeting more specifically quantified the potential hazard and a flammable hazard is estimated at a radius of 130 feet from the storage tank. Staff therefore recommends that the area within a 130 foot radius of the compressor station not be rezoned until such a time that the station is inactive and removed in compliance with City Oil and Gas Regulations. This process requires: • all surface installations should be removed • all foreign materials regardless of depth should be removed (excluding existing subsurface pipelines) • all holes and depressions filled with clean compatible soil • all oil or waste is removed from site ORDINANCE NO. Most of the inquiries were concerned with apartments, duplexes, or commercial on the property. Those in opposition are concerned about traffic on greens prairie road, density of the development, and storm water runoff and water quality. The Planning and Zoning Commission recommends denial of the rezoning due to 2 failed motions to approve the rezoning. Staff is recommending approval of the request except for that area within 130 feet of the compressor station until such a time that the station has been removed. WILLIAM D. Staff is recommending approval of the request with the condition that no residential lots be platted within 600 feet of the compressor station. STAFF REPORT The master plan before you is for a 200 acre development at 3370 Greens Prairie Road West. The applicant is proposing to develop the site under R- 1 for single family homes in 6 phases with an average density of 3.3 units per acre. A previous master plan of this subdivision, named River Stone, was approved in 2006. The current plan reduces the density from 3. 7 " c.-f ._, dwelilng units per acre. ~ .\J ~<"- Master Plans are intended to be a conceptual plan showing general land use layout, thoroughfares, and phasing. Emphasis is on the location of land uses, and the connections of thoroughfares and master utility lines. Some of the roads on this plan will require bl~o length variances at the time of preliminary plat, and approval of the Ma ter Plan does not override meeting all of the requirements of the subdivisi . n regulations at the time of plat. The applicant is proposing 3 access oints to Greens Prairie West, as well as extend 2 collectors through the roperty. The proposal also includes th evelopment of a 14 acre park. The park area also includes area in the 100-year floodplain. The property also has a compressor site at the southeast side of the property that serves the pipeline running along the east side of the property. REZONING BUFFER ITEM Staff recommends approval of the Master Plan. Project Manager: Lindsay Boyer, AICP, Senior Planner Report Date: September 10, 2007 Email: lboyer@cstx.gov Meeting Date: September 20, 2007 Project Number: 07-00500171 STAFF REPORT The item before you is a rezoning request for approximately 188 acres at 3370 Greens Prairie Road West from A-0 to R-1. The Subject property is in South College Station just north of the city limit located between Castlegate and Sweetwater Forest subdivision. C.Ortsililrs The area of the rezoning is identified as Medium and Rural Density on the Comprehensive Plan, and in this case where the tract has more than one comprehensive plan designation that is not clearly tied to a lot line or JJ.Q_..Q.L..leature, staff has made the interpretation that medium density residentia eets the intent of the Compreh nsive Plan. The original IS boundary was based on the sewer capaci , however the city has been C>ff~extending sewer into this area which su orts denser uses. As also seen in the neighboring Castlegate Subdivisio . /f NeiqnY7Mn"X f\-o~. \O'NcUvl5. ... arrvop. 3kpJ()k)V) b ./ The reioning ar~ excludes approxi at ly 14 acres for a proposed park. I This area includes the approxi at y 5 acres of the floodplain. There is also an existing compressor station on site in the southeast corner of the property. It is staff's understanding that a compressor station collects highly volatile and flammable material as a result of pressuring the pipeline. 1 If a new facility such as this were to locate near a residential area, City j Regulations would require a 600 foot minimum distance between the I station and any residential homes. Due to health and safety concerns, Staff is recommending that residential lots not be developed within 600 feet around the station in keeping with the intent of the City Oil and Gas Regulations. .1 m ;n&< o.. v tori·~ The property has access to Victoria Drive and Greens Prairie Road West. Development of the property will include the construction of an extension of Victoria, and an unnamed north-sout~collector. tv'\~l@' The property is approximately a half-mile from the developing Creek Meadows Subdivision. Staff has received 1 ~inquiries into the project, and 2 more in opposition to the rezoning. Most of the inquiries were concerned with apartments, duplexes, or commercial on the property. Those in opposition are STAFF REPORT Project Manager: Lindsay Boyer, AICP, Senior Planner Email: lboyer@cstx.gov Project Number: 07-00500170 Report Date: September 10, 2007 Meeting Date: September 20, 2007 Item: Public hearing, presentation, possible action, and discussion on a Rezoning for Preserve at Stone Creek consisting of approximately 188 acres from A-0, Agricultural Open to R-1, Single Family located at 3370 Greens Prairie Road West in the general area northeast of the intersection of Greens Prairie Road West and Sweetwater Drive between Castlegate Subdivision and Sweetwater Forest Subdivision. Applicant: Billy Chenault, agent for the owner Staff Recommendations: Staff recommends approval of the rezoning with the condition that no single family lot be platted within 600 feet of the compressor station. Item Summary: The applicant is requesting a rezoning from A-0, Agricultural Open to R-1, Single Family Residential in order to pursue the development of a residential subdivision on the tract. The property is adjacent to Castlegate subdivisi to the east (zoned POD), Sweetwater Forest Subdivision to the west (zoned A-OR), and u latted agricultural and vacant property to the north. The rezoning area also includes a compressors tion for a gas pipeline which runs along the east side of the property. This compressor sta · n will be considered a high impact site upon rezoning of the property. For new sites like t ·s, City oil and gas regulations would require that no new site be located with 600 feet of re 1dential unit unless waived by the owner of the residential unit. Due to the flammability o he materials at the compressor station, Staff is recommending that a condition be plac ti on the rezoning to limit residential development within 600 feet of the existing station. The applicant has also submitted a Master Plan and a Preliminary Plat for Phase 1 of the Subdivision. Comprehensive Plan Considerations: The Land Use Plan identifies this area as Single Family Residential, Medium Density with a portion of Floodplains and Streams on the east side of the property. The property has approximately 2,000 feet of frontage on Greens Prairie Road West. The Thoroughfare Plan on this property also shows the extension of Victoria as well as an additional north-south Major Collector that is unnamed at this time. The current traffic count estimate on Greens Prairie Road West is 2,500 trips per day. Existing capacity is estimated between 7,000 and 10,000 trips per day. When fully constructed to its thoroughfare designation, Greens Prairie Road West has a target volume of 5,000 to 10,000 trips. A subdivision of this size is estimated to produce around 6,600 trips per day at build-out. The Water/Wastewater Master Plan identifies a 12-inch water line along both major collectors, and an 8-inch sanitary sewer line along the extension of Victoria. Item Background: The subject property was annexed in 1995 and subsequently zoned A-0, Agricultural Open. The subject property was platted in the late nineteenth century as the 65 Benjamin Graham Subdivision. The property is located in the vicinity of the Creek Meadow Master Plan. Related Advisory Board Recommendations: None Commission Action Options: The Commission acts as a recommending body on the question of rezoning, which will be ultimately decided by City Council. The Commission options are: 1. Recommend approval of rezoning as submitted; 2. Recommend denial; 3. Table indefinitely; or, 4. Defer action to a specified date. INFRASTRUCTURE AND FACILITIES Water: There are existing water lines in the area. Water Master plan lines cross this property and will be required to be constructed with development. The water system for this area is required to meet City guidelines per the Subdivision Regulations. A Water Report is required for the subdivision o/time of platting to ensure compliance. Sewer: There are exiting sewer lines in tt/ area. A Sewer Report is required for the subdivision at time of platting to insure ca acity and compliance. Streets: The Thoroughfare Plan on th· property also shows the extension of Victoria as well as an additional north-south ajor Collector that is unnamed at this time. Drainage: Two-thirds of the property is in the Spring Creek drainage basin. The reaming area is located in the Peach Creek drainage basin. Flood Plain: There is approximately 6.5 acres of FEMA regulated floodplain on the property. This area as well as 8 additional acres surrounding the floodplain are proposed to be dedicated as parkland. Oversize request: None requested at this time. Impact Fees: A portion of the subject property is within Spring Creek Sanitary Sewer Impact Fee Area 97-01. Lots within the Impact Fee Area will pay impact fees at time of Building Permit.
