(07-75) Staff Planner Jason Schubert presented the staff report and stated that the applicant is requesting the variance to legitimize a building setback error made during construction. Chairman Goss opened the public hearing. Those speaking in favor of the variance request: Matthew Moore, 2924 Cain Road, College Station, Texas James Butcher, 4420 Spring Meadows, College Station, Texas Kit Kerbel, 4416 Spring Meadows, College Station, Texas Blinda Greenway, 4417 Spring Meadows, College Station, Texas Greg Taggert, 2551 Texas Avenue, College Station, Texas All speaking before the Board were sworn in my Chairman Goss. Chairman Goss closed the public hearing. Mr. Richards motioned to authorize of variance to the minimum setback from the terms of this Ordinance as it will not be contrary to the public interest, due to the following special conditions: honest mistake on tight radius of cul-de-sac lot when laid out by foundation crew; and because a strict enforcement of the provisions of the Ordinance would result in unnecessary hardship to this applicant being: unnecessary destruction of part of the house; and such that the spirit of this Ordinance shall be observed and substantial justice done subject to the following limitations: front setback of 3.92 feet. REQUEST: Front building setback variance LOCATION: 4418 Spring Meadows Drive PURPOSE: To legitimize a building setback error made during construction. GENERAL INFORMATION Status of Applicant: Property Owner & Home Builder Property Owner: Same as the applicant Applicable Ordinance Section: UDO Section 5.2, Residential Dimensional Standards PHYSICAL CHARACTERISTICS Zoning and Land Use Subject Property: R-1, Single-Family Residential; Single family home North: R-1, Single-Family Residential; Single family home West: R-1, Single-Family Residential; Spring Meadows Drive East: R-1, Single-Family Residential; Subdivision common area South: R-1, Single-Family Residential; Single family home Frontage:50' of frontage on a "knuckle" of Spring Meadows Dr. Access: Driveway access to Spring Meadows Dr. Topography & Vegetation: The property slopes to the front and rear of the property with some vegetation. Flood Plain: Not within the floodplain. VARIANCE INFORMATION Background: This case involves an error made by the builder in adhering to the 25-foot front building setback. The two outside corners of the front of the residence are located outside of the setback. However, due to the radius of the cul-de-sac knuckle not being observed, the garage and front porch each encroach into the front setback. The result is an encroachment that reaches 21.08 feet from the front property line to the closest part of the residence; thus the applicant is requesting a front setback variance of 3.92 feet. ANALYSIS Special Conditions: The applicant states that "when the house was laid out by the foundation crew, they missed the tighter radius of the cul de sac. Notice both outside corners of the residence are behind the 25' setback. This was an omission and oversight to observe the radius." In the application, it is also stated that the variance will not be contrary to the public interest as it "will not effect the vista or viewpoint of the surrounding residences due to its placement in the cul de sac" and that it does "not effect the fire safety of the side setbacks." Hardships: The applicant did not state a hardship. Alternatives: The applicant has identified no alternatives "due to the completed stage of the home." Recommendation: Staff recommends denial for this variance request. The applicant has only identified an error to observe the front setback radius as the special condition or hardship; therefore staff can not support this variance request. SPECIAL INFORMATION Ordinance Intent: Building setback requirements usually allow for some degree of control over population density, access to light and air, and fire protection. These standards are typically justified on the basis of the protection of property values.
