TCEQ Phase II Rules In Effect** The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate construction site in accordance with the approved erosion control plan as well as the City of College Station Drainage Policy and Design Criteria. If it is determined the prescribed erosion control measures are ineffective to retain all sediment onsite, it is the contractors responsibility to implement measures that will meet City, State and Federal requirements. The Owner and/or Contractor shall assure that all disturbed areas are sodden and establishment of vegetation occurs prior to removal of any silt fencing or hay bales used for temporary erosion control. The Owner and/or Contractor shall also insure that any disturbed vegetation be returned to its original condition, placement and state. The Owner and/or Contractor shall be responsible for any damage to adjacent properties, city streets or infrastructure due to heavy machinery and/or equipment as well as erosion, siltation or sedimentation resulting from the permitted work. In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be taken to insure that debris from construction, erosion, and sedimentation shall not be deposited in city streets, or existing drainage facilities. I hereby grant this permit for development of an area outside the special flood hazard area. It is my understanding that you have agreed to replace the cracked section of concrete curb/gutter, crack seal the asphalt street, and provide the City with a one year maintenance bond. The City agrees with the proposed concrete curb repair, please contact our Engineering Inspector,Jerry Jones at(979) 777-4594 before the repair begins. However, the City does not agree with the proposed crack seal repair and maintenance bond for this particular section of asphalt street. The crack in this area was significantly worse than the others found further down Appomattox Drive, as you can see from the attached photo. The City requests that you remove and replace this sub-grade, base and asphalt section. Upon removing a section of asphalt it was apparent that the crack was present in the base and sub-grade, which warrants the base and sub-grade repair, as you can see from the attached photo. By not conforming to this request your subdivision, Horse Haven Phase 4, will be considered non compliant with the City's warranty policies. The irrevocable letter of credit shall be renewed each year until such time as the Improvements are constructed or until such time as the Extension or Utilities are removed from the Thoroughfare Plan or Master Utility Plan. The OWNER, its successors-in-interest, heirs and assigns, hereby releases, relinquishes and discharges the CITY, its agents, officers, and employees, from all claims, demands, and causes of action of every kind and character,including the cost of defense thereof, for any loss of or damage to property (whether property of either the parties hereto, their employees, or of third parties)that is caused by or alleged to be caused by, arising out of, or in connection with this Agreement. This release shall apply regardless of whether said claims, demands, and causes of action are covered in whole or in part by insurance and regardless of whether such loss or damage (collectively, "Damage") was caused in whole or in part by the negligence of the CITY. 11. This Agreement has been made under and shall be governed by the laws of the State of Texas. Venue shall lie in a court ofcompetent jurisdiction in Brazos County, Texas. 12. If it is determined that the CITY had no authority to enter into this Agreement, then the OWNER agrees that it shall meet all conditions required by the CITY'S Subdivision Regulations and the Thoroughfare Plan or the CITY will not approve the final plat of Lot 2. OWNER warrants that it is the only record owner of Lot 2, Horse Haven Estates. The parties agree that they have read the terms of this Agreement and familiarized themselves with the requirements hereunder and agree that they understand their rights and responsibilities hereunder. It is understood and agreed that this Agreement shall be binding upon and shall inure to the benefit of the parties and their respective heirs, lessees, representatives, successors, and assigns. No oral understandings, statements, promises or inducements contrary to the terms of this Agreement exist. This Agreement cannot be changed or terminated unless in writing and agreed by both parties. 15. Failure of either party, at any time, to enforce a provision of this Agreement, shall in no way constitute a waiver of that provision, nor in any way affect the validity of this Agreement, any part hereof,or the right of either party thereafter to enforce each and every provision hereof. 16. It is the intention ofthe parties that the Original Agreement shall remain in effect and not be superseded by this Agreement until such time as the condition precedent referred to in the succeeding sentence is satisfied. Ken Fogle, Transportation Planner, was called upon by the Commission to answer questions in general regarding the flow of traffic on FM 2818 near the project. All of the individuals spoke in opposition to the Rezoning. Some of the concerns were the opening of Switch Station Road, traffic flow, opening Appomattox Drive, lot size, parkland dedication in lieu of fees, lighting for the parking lot, neighborhood integrity, connectivity and highway frontage. Jennifer Prochazka, Senior Planner and Ken Fogle, Transportation Planner, were called upon by the Commission to answer additional questions by the Commission. Most of the questions were concerning the flow of traffic and an update of the East Side Transportation Study. Commissioner Dictson motioned to recommend approval of the Rezoning to City Council. Commissioner Sanford seconded the motion, motion passed 4-0). 8.Discussion and possible action on future agenda items — A Planning and Zoning Member may inquire about a subject for which notice has not been given. A statement of specific factual information or the recitation of existing policy may be given. Commissioner Dictson mentioned that he would like a workshop regarding the topic of the ETJ. It was mentioned that this topic is scheduled for the August 16, 2007, workshop agenda. 9. Adjourn.
