Sizes will be established by water analysis and compliance with BCS Unified Manual. Water will be available for extension into Bald Prairie once line is constructed. Water Service: Domestic service to be provided to all platted lots. Sewer required for plat: Sewer area to be established by sewer report. Portions of the Bald Prairie Subdivision are in the sewer shed of this development. The City will look for extension of the public system so as to provide continuity of development. This plat complies with this restriction. Off-site Easements required for plat: None known to be needed at this time. Drainage: This subdivision is required to meet the City's drainage regulations. The general flow pattern of the subject site is to the north. It appears the proposed detention pond will flow into the existing detention pond in the City Park at Hartford and Victoria. Flood Plain: There is no FEMA floodplain on the site. It is imperative that floodplain is not created by development; i.e. the drainage way along the north side of the subdivision should not impact residential lots with floodwaters. MEMORANDUM May 26, 2005 TO: Planning and Zoning Commission FROM: Jennifer Reeves Email: jreeves@cstx.gov SUBJECT: PRELIMINARY PLAT for EDELWEISS GARTENS PHASES 6-12 Item: Public hearing, discussion, and possible action on a Preliminary Plat for the Edelweiss Gartens Phases 6-12 consisting of 367 lots on 94.417 acres generally located at Victoria Avenue and Night Rain Drive. This item includes a Replat of Lots 1, 4, 5, 6, 7, and 8 of the Bald Prairie Subdivision. Applicant: Edelweiss Gartens Venture, Owner Staff Recommendations: Staff recommends approval of the Preliminary Plat as submitted. Item Summary: This item is for consideration of a Preliminary Plat for Edelweiss Gartens Phases 6-12 which includes a Replat of Lots 1, 4, 5, 6, 7, and 8 of Bald Prairie Subdivision. The subdivision is proposed south of the existing Edelweiss Gartens Phases 1- 5, east of Victoria Avenue and along the Future State Highway 40. The plat includes areas zoned R-1, R-2 and R-3. A portion of Phase 6 which has already been final platted is zoned R-3. R-1 development is permitted in R-3 if done to R-1 standards. A note on the plat limits the property on the plat to development under R-1 standards. All lots in this area meet minimum R-1 standards. Phase 10 is zoned R-2. All lots in Phase 10 meet minimum R-2 standards. Each lot is 70-ft wide or greater. Therefore no additional requirements for access and/or parking are placed on these lots. There is a buffer requirement when R-2 develops adjacent to R-1. Buffer requirements are implemented with a building permit. The development is providing several alleys. When a lot has approved rear access the front setback can be reduced to 15 feet. Although this is not required after preliminary plat approval, if City alley standards change before construction, the Developer may wish to provide a revised plat. A portion of the subject area is being replatted. The Replat requires that a public hearing be held. The public hearing only applies to the areas being replatted as noted on the Preliminary Plat and not to the surrounding property. Comprehensive Plan Considerations: Land Use Plan: Shown as single-family residential. Thoroughfare Plan: Eagle Avenue is shown as a Minor Collector. Victoria Avenue is a Major Collector. State Highway 40 is a Freeway Expressway. Parkland Dedication: The Parks Board has approved this development to dedicate parkland as shown on the plat. The Commission is the final approving authority. Open Space Dedication: There is a Drainage ROW to be dedicated to the City separating this subdivision from Phases 4 and 5. Preliminary discussions alluded to this drainage way consisting of grassy side slopes with a concrete flow channel. Sidewalks: Required on both sides of Brandenburg Lane, Santour Drive, Eagle Avenue, and Victoria Avenue; on one side of all residential streets; and not required on cul-de-sacs. AN ORDINANCE MAKING CERTAIN FINDINGS OF FACT AND VACATING AND ABANDONING A 0.583-ACRE PORTION OF THE SIXTY FOOT (60') WIDE RIGHT-OF- WAY OF RENEE LANE, IN THE CITY OF COLLEGE STATION,TEXAS. WHEREAS, the City of College Station has received an application for the vacation and abandonment of a sixty foot (60') wide right-of-way, being more particularly described on Exhibit"A" attached hereto; and WHEREAS on April 28, 2005, the City Council of the City of College Station, Texas, heard the application of Edelweiss Gartens Venture and Lick Creek Farm & Ranch Trust,both represented by Steve Arden for the vacation and abandonment of the aforementioned sixty foot (60') wide right-of-way according to the Final Plat of Bald Prairie Subdivision recorded in Volume 321, Page 571, of the Official Records of Brazos County,Texas; and WHEREAS, in order for any portion of an easement to be vacated and abandoned by the City Council of the City of College Station,the Council must make certain findings of facts; and WHEREAS, after hearing the application of Steve Arden to vacate and abandon a sixty (60) foot wide right-of-way,the City Council of the City of College Station, finds the following facts: 1. The location of a sixty foot (60') wide right-of-way is adjacent to the applicant's property and inhibits its development. Steve Arden is the Managing Partner of Edelweiss Gartens Venture and has provided a Letter of Appointment from Lick Creek Farm & Ranch Trust authorizing Steve Arden as "Authorized Agent" to request, file and execute all applications and permits required and necessary thereto, including incorporating the development of the Real Property into Plats and Re-Plats of any adjacent subdivisions; and 2. There is no utility infrastructure in the right-of-way; and 3. The section of roadway to be abandoned does not provide public access to any other properties; and 3. That the land use in the neighborhood appears to be stable and the use to which this property is being put is not likely to change within the foreseeable future and is similar to the use to that of the neighborhood; WHEREAS,the City Council after hearing the application and finding the specific facts as stated above now concludes and finds that: 1. The fact that the location of the sixty foot (60') wide right-of-way is adjacent to the applicant's property would deprive the applicant of the reasonable use of his property because this abandonment would enable an improved street layout with increased connectivity for the remainder of Renee Lane. 2. The fact that the land use is not likely to change within the foreseeable future provides a basis for granting applicant's request to vacate and abandon a portion of the public right-of-way necessary for the preservation and enjoyment of the substantial property right of the applicant. The fact that the abandonment of a portion of the right-of-way is not detrimental to the public health, safety or welfare or injurious to the property in the area; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that a sixty foot (60') wide strip of land previously platted as a public right-of-way, which was dedicated in Final Plat of Bald Prairie Subdivision recorded in Volume 321, Page 571 in the City of College Station, as described on Exhibit "A" attached hereto, be abandoned and vacated only upon completion of the following condition: 1. Applicant shall design and construct a cul-de-sac located at the new terminus of Renee Lane meeting all applicable City standards within six (6) months of the abandonment. Recommendation(s): Staff recommends approval of the Application for Abandonment of the ROW. Summary: The portion of Renee Lane to be abandoned is 423.30-feet in length and 60-feet in width. Renee Lane currently dead ends to the north in this subject vicinity. The development of future phases of Edelweiss Gartens Subdivision proposes to provide a street connection back through the subdivision to Victoria Avenue for increased connectivity. Additionally, there are no public utilities within the subject ROW to be abandoned. During the application process residents were contacted. Some opposition was expressed. This item includes a public hearing to allow these concerns to be brought to Council. Also of concern to me is the fact that without Renee Lane being a through street that we will have to go under Victoria to get the hook up to the city sewer system that was promised to us when we were annexed into the city. I can see going under a connector street costing in the 5-figure area. As most of us do not have that kind of money it could be years before we could hook into it. Another reason is the zoning. I would like to know if the city is going to keep the AO zoning for this property. The zoning and lack of city services have kept the property values on mine, and the rest of the residents of Renee Lane for years. Being close to a high school will not make it any better if these things are not addressed first I met with Mr. Alan Gibbs and he was under the impression that the traffic flow problem was not from Barron Rd to Mountain Breeze but the other way around. I do not see a problem there. Why would they want to come that way? There isn't anything there but the high school and more housing. Access to highway 6 would be closer by using Mountain Breeze. I realize that Mr. Arden is in business to make money for his investors and himself. I also realize that the cul de sac will be very cost effective for him and he will be able to build more houses. However, I don't think that I, and the rest of the residents of Renee Lane should pay for his ability to do so. Hearne, TX 77859-9271 Dear Ms. Hester: The current development plans for the Edelweiss Gartens Subdivision include an east/west collector street that intersects with your street, Renee Lane. This new street, Mountain Breeze, is to eventually be a major connector from Hwy 6 to the new Hwy 40 as you can see on the enclosed plat. It is of concern that Renee Lane will become a straight "raceway" for students traveling from the new High School that will be located at the intersection of Renee Lane and Barron Road. Traffic around the High School and, in particular, the intersection of Victoria and Barron could be significant. Since Renee Lane is parallel to the real collector street, Victoria, students will most likely use Renee Lane as an alternate route. This would certainly change the quiet, residential nature of the street. A solution to the potential problem has presented itself. The addition of lots 4 and 5 of the Bald Prairie Subdivision would accommodate a cul de sac at the northern end of Renee Lane. Traffic not using Victoria to move northward to Mountain Breeze Lane would be diverted to Passendale Lane, then onto Latinne Lane in order to get through. This less direct route would discourage non-resident through-traffic. Plat 2 illustrates where the cul de sac on Renee Lane would be constructed and how the traffic pattern would change. College Station requires neighbor input for the consideration of closing a street such as that being proposed for the north end of Renee Lane. This item includes a Replat of Lots 1A, 4, 5, 6, 7, and 8 of the Bald Prairie Subdivision. Applicant: Edelweiss Gartens Venture, Owner Staff Recommendations: Staff recommends approval of the Preliminary Plat as submitted. Item Summary: This item is for consideration of a Preliminary Plat for Edelweiss Gartens Phases 6-12 which includes a Replat of Lots 1A, 4, 5, 6, 7, and 8 of Bald Prairie Subdivision. The subdivision is proposed south of the existing Edelweiss Gartens Phases 1- 5, east of Victoria Avenue and along the Future State Highway 40. The plat includes areas zoned R-1, R-2 and R-3. A portion of Phase 6 which has already been final platted is zoned R-3. R-1 development is permitted in R-3 if done to R-1 standards. A note on the plat limits the property on the plat to development under R-1 standards. All lots in this area meet minimum R-1 standards. Phase 10 is zoned R-2. All lots in Phase 10 meet minimum R-2 standards. Each lot is 70-ft wide or greater. Therefore no additional requirements for access and/or parking are placed on these lots. There is a buffer requirement when R-2 develops adjacent to R-1. Buffer requirements are implemented with a building permit. The development is providing several alleys. When a lot has approved rear access the front setback can be reduced to 15 feet. Although this is not required after preliminary plat approval, if City alley standards change before construction, the Developer may wish to provide a revised plat. A portion of the subject area is being replatted. The Replat requires that a public hearing be held. The public hearing only applies to the areas being replatted as noted on the Preliminary Plat and not to the surrounding property. There is a Drainage ROW to be dedicated to the City separating this subdivision from Phases 4 and 5. Preliminary discussions alluded to this drainage way consisting of grassy side slopes with a concrete flow channel. Sidewalks are required on both sides of Brandenburg Lane, Santour Drive, Eagle Avenue, and Victoria Avenue, and on one side of all residential streets. Sidewalks are not required on cul-de-sacs. Sizes will be established by water analysis and compliance with BCS Unified Manual. Water will be available for extension into Bald Prairie once line is constructed. The abandonment of Rene Lane was conditioned on the developer constructing a cul-de-sac at the end of Rene Lane within 6 months of the abandonment. The abandonment is null and void if the cul-de-sac is not constructed. Per the UDO, residential drives are restricted from connecting to a collector street and above. This plat complies with this restriction. Off-site Easements required for plat: None known to be needed at this time. Drainage: This subdivision is required to meet the City's drainage regulations. The general flow pattern of the subject site is to the north. It appears the proposed detention pond will flow into the existing detention pond in the City Park at Hartford and Victoria. Flood Plain: There is no FEMA floodplain on the site. It is imperative that floodplain is not created by development; i.e. the drainage way along the north side of the subdivision should not impact residential lots with floodwaters. Maims ee ; corner o MEMORANDUM September 16, 2004 TO: Planning and Zoning Commission FROM: Spencer Thompson, Graduate Civil Engr Email: sthompson@cstx.gov SUBJECT: REPLAT FOR BALD PRAIRIE LOTS 6, 7 & 8 AND A FINAL PLAT for EDELWEISS GARTENS PH 6 Item: Public hearing, discussion, and possible action on a Replat for Bald Prairie Lots 6, 7 & 8 and a Final Plat for Edelweiss Gartens PH 6 consisting of 58 lots on 15.7 acres generally located at Victoria Avenue and Night Rain Drive. (04-00500191) Applicant: Steve Arden, Owner/ Developer. Staff Recommendations: Staff recommends approval of the Final Plat. Item Summary: This item is set for a Public Hearing because a section of the subject property involves a Replat of a portion of the Bald Prairie Subdivision. The original plat for Bald Prairie was filed in 1973 and therefore does not come under Section 18 of the Subdivision Regulations for older subdivisions. All proposed lots meet the standards of the Subdivision Regulations. The majority of the subject area is zoned R-1 . However, a portion of the subject area is zoned R-3. All lots are being platted to meet R-1 standards as allowed by the UDO. Mountain Breeze Way is a Minor Collector and will connect to Victoria. The Victoria connection is being dedicated with this plat to meet the requirements of Section 8-G.2 of the Subdivision Regulations which states: No tract, lot or parcel shall be subdivided unless the required internal street system adjoins an existing, paved public right-of-way. The off-site portion of Victoria was constructed and paved with Westfield Village Phase 6 but not dedicated as infrastructure. Mountain Breeze Way will connect with Renee Lane and eventually with SH 40, now under construction. The Developer is proposing "lot-line construction" for all lots except Lot 7 on Faimes Court, as shown on the Plat. Homes will be constructed on the lot line opposite the Maintenance Easement (ME). The eave of the home on the lot line is allowed to extend over the property line. The ME restricts storage of combustible items in the area under the eave of the neighboring home. The proposed plat meets the regulations for lot line construction as outlined in Section 8.2 of the UDO. The plat includes additional areas to be dedicated as parkland. A future park is proposed adjacent to Latinne Ct, as recommended by the Parks Board. The plat also includes several HOA easements. Edelweiss developments are well known for having landscaped areas adjacent to thoroughfares. Comprehensive Plan Considerations: Land Use Plan: Single-family, residential Thoroughfare Plan: Mountain Breeze Way is classified as a Minor Collector Parkland Dedication: Requirements are being met with land dedication. Subdivision Design and Improvements 8.2 Lot Line Construction The following requirements apply to all single-family residential development. A. Description A zero lot line development is where houses in a development on a common street frontage are shifted or offset to one side of their lot. This provides for greater usable yard space on each lot. These developments require that planning for all of the house locations be done at the same time. Zero lot line developments are allowed by right. Review for compliance with the standards of this Section shall occur during the subdivision platting process. Restrictions that assure the minimum distance between houses and any required easements must be recorded on the plats of the applicable lots. Proof of such recordation must be submitted as part of the building permit application. B. Setbacks The side building setback may be reduced to zero on one side of the house. This reduction does not apply to the street side setback or to the interior side setback adjacent to lots that are not part of the zero lot line project. The reduced setback may be located anywhere between the lot line and the minimum setback required for the district. The minimum distance between all buildings in the development must be fifteen feet. C. Additional Standards 1. Eaves The eaves on the side of a house with a reduced setback may project a maximum of 18 inches over the adjacent property line. In this case, an easement for the eave projection must be recorded on the plat and deed for the lot where the projection occurs. 2. Maintenance Easement An easement between the two property owners to allow for maintenance or repair of the house is required when the eaves or side wall of the house are within four feet of the adjacent property line. The easement on the adjacent property must provide at least five feet of unobstructed space between the furthermost projection of the structure and the edge of the easement. These easements must be shown on the recorded plat. 3. Privacy If the sidewall of the house is on the property line, or within three feet of the property line, windows or other openings that allow for visibility into the side yard of the adjacent lot are not allowed. Windows that do not allow visibility into the side yard of the adjacent lot, such as a clerestory window or a translucent window, are allowed. All materials within three feet of the property line shall be fire-rated to meet building code requirements.
